County commissioners-budget oversight authority.

A BILL
for
AN ACT
relating to the Uniform Municipal Fiscal Procedures Act; providing for budget
submission and approval of special purpose districts as specified; authorizing
special purpose district mill levy reduction by county commissioners; and
providing for an effective date.
Be It Enacted by the Legislature of the State of Wyoming:
Section 1. W.S. 16-4-104(a)(intro) and 16-4-111(b) and (c) are amended to read:
16-4-104. Preparation of
budgets; contents; review; subsequent authorized projects.
(a) On or before May 15, the budget officer shall prepare a tentative
budget for each fund and file the budget with the governing body. Any
special purpose district described in W.S. 16-4-104(f) shall submit its budget
to the county clerk of any county in which the district is located. All departments shall submit budget requests
to the appropriate budget officer on or before May 1. The format of the budget
shall be prepared to best serve the municipality except that the budget formats
for community colleges shall be uniform and approved by the community college
commission and the director of the state department of audit. The budget shall
set forth:
16-4-111. Adoption of budget.
(b) Prior to adopting the budget, the county commissioners may veto,
in whole or in part, line items of
budgets presented by boards which were totally appointed by the county
commissioners deny or reduce any mill levy requested in the
budget of any special purpose district described in W.S. 16-4-104(f) if the
county commissioners find that
the purposes of the district are not being met, or if the resources from the
requested mill levy exceed the needs of the district. For any special purpose
district described in W.S. 16-4-104(f) which crosses county
boundaries, such determination
shall be made in accordance with the procedures set
forth in W.S. 22—29-103(c).
(c) Boards, the members of which are appointed by the county
commissioners, shall expend funds only as authorized by the
approved budget pursuant to subsection (b) of this section
unless a departure from the budget is authorized by the board of county
commissioners.
Section 2. This act is effective July 1, 2001.
