State parks-amendments.

A BILL

 

for

 

 1  AN ACT relating to state parks; requiring the department of
 2  state parks and cultural resources to set hours of
 3  operation for bathhouses located in Hot Springs State Park;
 4  modifying limits on Hot Springs State Park campground fees;
 5  eliminating the state parks advisory board; and providing
 6  for effective dates.

 7 

 8  Be It Enacted by the Legislature of the State of Wyoming:

 9 

10         Section 1.  W.S. 36-8-304 is amended to read:

11 

12         36-8-304.  Public baths; public campgrounds; lease of
13  park lands.

14 

15         (a)  The department of state parks and cultural
16  resources shall retain one-fourth (1/4) of the water in the

 1  main or largest principal spring on the state land on the
 2  eastern bank of the Big Horn River with sufficient quantity
 3  of the land adjacent thereto, upon which suitable
 4  bathhouses may be constructed, which shall be open, with
 5  preference of use given free to persons who are indigent
 6  and suffering from ailments for which bathing in the waters
 7  of the Big Horn Hot Springs will afford relief. The
 8  department may make necessary rules and regulations
 9  governing free baths, the manner and time of bathing, and
10  may require medical examination of applicants for baths.
11  The bathhouse shall remain open not less than ten (10)
12  hours a day each weekday and not less than six (6) hours on
13  Sundays and holidays and in consultation with the
14  commission, shall establish the hours of bathhouse
15  operation.

17         (b)  The department, in consultation with the
18  commission, may set apart a suitable location and portion
19  of the lands for public camping purposes but may contract
20  for operation of any campgrounds by competitive sealed bid.
21  Should If the department, in consultation with the
22  commission, operate operates any campground within Hot
23  Springs State Park, the charges per night shall not be less
24  than one-half (1/2) of the average charges imposed by

 1  private campground operators within a five (5) mile radius
 2  of the Hot Springs State Park.

 4         (c)  The balance of the water and lands may be leased
 5  by the department, in consultation with the commission, for
 6  a term not less than five (5) years nor longer than
 7  ninety-nine (99) years. The length of the term of each
 8  individual lease shall be determined by the department, in
 9  consultation with the commission, in accordance with the
10  value of the improvements proposed and actually placed upon
11  the leasehold. The department may by rule provide for
12  special use permits for limited purposes. The department
13  may make adopt rules and regulations with respect to for
14  the erection of buildings and improvements upon the
15  individual leaseholds and may prescribe the plans and
16  specifications of, and the materials to be used in the
17  buildings to be erected. The department, in consultation
18  with the commission, mayin any lease may provide for such
19  plans and buildings and such building use thereof as will
20  best carry out the purposes of this chapter in retaining
21  which best retains the lands and waters thereon within the
22  park for the treatment and cure of diseases and the
23  pleasure of the general public.

 1         (d)  The department, in consultation with the
 2  commission, may conduct through pipes or otherwise, any
 3  portion of the waters of the hot springs reserved for free
 4  use under subsection (a) of this section, and to provide
 5  for providing other baths and bathhouses for the use of the
 6  water at such rental or rates as it prescribes.

 7 

 8         Section 2.  W.S. 36-4-102 is repealed.

 9 

10         Section 3.  This act is effective July 1, 2001.
