A BILL

 

for

 

 1  AN ACT relating to persons with disabilities; expanding
 2  current provisions accommodating persons with disabilities;
 3  modifying provisions for the use of guide dogs to allow for
 4  the use of service dogs; providing definitions; and
 5  providing for an effective date.

 6 

 7  Be It Enacted by the Legislature of the State of Wyoming:

 8 

 9         Section 1.  W.S. 35-13-205 is created to read:

11         35-13-205.  Definitions.

13         (a)  As used in this article:

 1              (i)  "Service dog" means a dog which has been or
 2  is being specially trained to the requirements of a person
 3  with a disability;

 4 

 5              (ii)  "Person with a disability" means an
 6  individual who has a mental or physical impairment which
 7  substantially limits one (1) or more major life activities;

 8 

 9              (iii)  "Major life activities" means functions
10  associated with the normal activities of independent daily
11  living such as caring for one's self, performing manual
12  tasks, walking, seeing, hearing or speaking.

14         Section 2.  W.S. 35-13-201(a)(intro), (iii) and (b),
15  35-13-203 and 35-13-204(a) are amended to read:

17         35-13-201.  Generally; use of service dogs.

18 

19         (a)  Any blind, visually handicapped impaired, deaf,
20  hearing impaired person or otherwise disabled other person
21  with a disability, subject to the conditions and
22  limitations established by law and applicable alike to all
23  persons:

 1              (iii)  Shall not be discriminated against in the
 2  leasing or rental of apartments and other private
 3  residential property because of his handicap disability.

 4 

 5         (b)  Any blind, visually handicapped impaired, deaf,
 6  or hearing impaired person or other person with a
 7  disability may be accompanied by a guide service dog,
 8  specially trained and certified for the purpose, in any of
 9  the places listed in subsection (a) of this section without
10  paying an extra charge for the guide service dog, shall not
11  be discriminated against in the leasing or rental of
12  residential property because the person has a guide service
13  dog and is liable for any damage done to the premises or
14  facilities by the dog.

16         35-13-203.  Interfering with rights; penalty.

17 

18  Any person denying or interfering with admittance to or
19  enjoyment of the public facilities enumerated in W.S.
20  35-13-201 or otherwise interfering with the rights of the
21  blind, partially blind, deaf, hearing impaired person or
22  otherwise disabled other person with a disability is guilty
23  of a misdemeanor and may be fined not more than seven
24  hundred fifty dollars ($750.00).

 2         35-13-204.  Additional provisions on use of service
 3  dogs; penalty.

 4 

 5         (a)  Any blind, partially blind, deaf, or hearing
 6  impaired person or other person with a disability who is a
 7  passenger on any common carrier, airplane, motor vehicle,
 8  railroad train, motor bus, boat or any other public
 9  conveyance operating within the state may have with him a
10  guide service dog. specially trained and certified for that
11  purpose.

13         Section 3.  This act is effective immediately upon
14  completion of all acts necessary for a bill to become law
15  as provided by Article 4, Section 8 of the Wyoming
16  Constitution.
