Health insurance-cancer screenings.

A BILL

 

for

 

 1  AN ACT relating to group disability insurance; specifying
 2  group disability insurance benefits or coverage for
 3  specified cancer screenings; authorizing a copayment for
 4  cancer screenings as specified; and providing for an
 5  effective date.

 6 

 7  Be It Enacted by the Legislature of the State of Wyoming:

 8 

 9         Section 1.  W.S. 26-19-107 by creating new subsections
10  (j) and (k) is amended to read:

11 

12         26-19-107.  Group disability and blanket insurance
13  standard provisions; exceptions.

14 

15         (j)  All group and blanket disability insurance
16  policies providing coverage on an expense incurred basis,

 1  individual and group service or indemnity type contracts
 2  issued by a nonprofit corporation, individual and group
 3  service contracts issued by a health maintenance
 4  organization, all self-insured group arrangements to the
 5  extent not preempted by federal law and all managed health
 6  care delivery entities of any type or description, that are
 7  delivered, issued for delivery, continued or renewed on or
 8  after July 1, 2001, and providing coverage to any resident
 9  of this state shall provide benefits or coverage for:

11              (i)  A pelvic examination and pap smear for any
12  nonsymptomatic women covered under the policy or contract;
13  and

14 

15              (ii)  A colorectal cancer examination and
16  laboratory tests for cancer for any nonsymptomatic person
17  covered under the policy or contract;

18 

19              (iii)  A prostate examination and laboratory
20  tests for cancer for any nonsymptomatic man covered under
21  the policy or contract; and

 1              (iv)  A breast cancer examination including a
 2  screening mammogram and clinical breast examination for any
 3  nonsymptomatic person covered under the policy or contract.

 4 

 5         (k)  To encourage public health and diagnostic health
 6  screenings, the services covered under subsection (j) of
 7  this section shall be provided with no deductible due and
 8  payable. A health plan shall, at a minimum, be liable for
 9  eighty percent (80%) of the reimbursement allowance of the
10  health plan up to a maximum of two hundred fifty dollars
11  ($250.00) per adult insured per year. A patient shall be
12  liable for coinsurance up to twenty percent (20%) if such
13  coinsurance is required pursuant to the patient's health
14  care coverage. Coverage may be in addition to any other
15  preventive care services. Nothing in this subsection or
16  subsection (j) of this section shall apply to accident only
17  policies, high deductible policies where the deductible
18  equals or exceeds one thousand dollars ($1,000.00) per
19  person per year, policies qualifying as federal medical
20  savings accounts, long term care or disability income
21  policies.
