Motor vehicles-open container law.

A BILL
for
1 AN ACT relating to motor
vehicles; prohibiting consumption
2
or possession of alcoholic beverages in motor vehicles as
3
specified; providing a definition; providing a penalty; and
4
providing for an effective date.

6 Be It Enacted by the Legislature of the State of Wyoming:
7
8 Section 1. W.S. 31-5-235 is created to read:
9
10 31-5-235. Consumption and possession
of alcoholic
11 beverages in opened containers by operator
of vehicle
12 prohibited; definitions; penalty.
13
14 (a) As used in
this section, "alcoholic beverage"
15 means alcoholic liquor or malt
beverage as defined in W.S.
16 12-1-101(a)(i), (vii) and (x).

2 (b) No person
shall consume or possess any alcoholic
3
beverage while operating a motor vehicle on a public street
4
or public highway unless the beverage is in the original
5
unopened package or container, the seal of which has not
6
been broken and from which the original cap, cork or other
7
means of closure has not been removed.

9 (c) Any person
violating the provisions of this
10 section shall:
11
12 (i) For a first
conviction or a subsequent
13 conviction not occurring within one
(1) year after the
14 first conviction, be punished by a
fine of not more than
15 two hundred dollars ($200.00);
16
17 (ii) For a
second conviction within one (1) year
18 after the first conviction, be
punished by a fine of not
19 more than three hundred dollars
($300.00) or by
20 imprisonment for not more than
thirty (30) days, or both;
21
22 (iii) For a third
or subsequent conviction
23 within one (1) year after the first
conviction, be punished
24 by a fine of not more than five
hundred dollars ($500.00)

by imprisonment for not more than six (6) months, or

both.

4 Section 2. This act is effective July 1, 2001.
