Genetic testing to establish paternity-amendments.

A BILL

 

for

 

 1  AN ACT relating to genetic testing to establish paternity;
 2  amending the time period genetic materials are maintained;
 3  clarifying provisions; eliminating limitation on uses of
 4  genetic material; and providing for an effective date.

 5 

 6  Be It Enacted by the Legislature of the State of Wyoming:

 7 

 8         Section 1.  W.S. 14-2-109(j) through (m) is amended to
 9  read:

10 

11         14-2-109.  Genetic tests; experts; presumptions;
12  dismissal based on genetic tests; genetic test material;
13  use of genetic information; penalty.

15         (j)  In all cases where paternity testing is
16  undertaken, all genetic information, including genetic

 1  material and test results, shall be maintained only until
 2  the final determination of paternity is made as long as the
 3  accreditation body specified in subsection (b) of this
 4  section requires such materials to be maintained for
 5  accreditation purposes. Thereafter, all materials shall be
 6  destroyed or returned to the individual from whom the
 7  information was obtained.

 8 

 9         (k)  No testing shall be conducted on any identifiable
10  genetic material for purposes other than paternity
11  determination without the written consent of the individual
12  from whom the genetic material is obtained.

13 

14         (m)  All information obtained from identifiable
15  genetic material submitted or used for determination of
16  paternity shall be confidential and used solely for the
17  purposes of determining paternity, unless individual
18  identifiers are removed from the data used for purposes
19  other than establishing paternity.

 1         Section 2.  This act is effective immediately upon
 2  completion of all acts necessary for a bill to become law
 3  as provided by Article 4, Section 8 of the Wyoming
 4  Constitution.
