Workers' compensation-boards and commissions.

A BILL
for
1 AN ACT relating to
workers' compensation; amending workers'
2
compensation provisions to address issues decided by the
3
Wyoming supreme court with respect to coverage for members
4
of boards and commissions; expanding coverage as specified;
5
conforming provisions; and providing for an effective date.

7 Be It Enacted by the Legislature of the State of Wyoming:

9 Section
1. W.S. 27-14-102(a)(vii)(N) and by creating
10 a new paragraph (xxviii) and 27-14-108(d)(iii)
are amended
11 to read:

13 27-14-102. Definitions.
14
15 (a) As used in this act:

1 (vii) "Employee"
means any person engaged in any
2
extrahazardous employment under any appointment, contract
3
of hire or apprenticeship, express or implied, oral or
4
written, and includes legally employed minors and aliens
5
authorized to work by the United States department of
6
justice, immigration and naturalization service. "Employee"
7
does not include:
8
9 (N) An elected
public official or an
10 appointed member of any governmental board or commission,
11 except for a duly elected or
appointed sheriff;
12
13 (xxviii) "State employee" means any individual
14 entering
into service of or working under an employment
15 contract with any agency of the state of Wyoming, including
16 the University of Wyoming, for which compensation is paid
17 or which qualifies the individual to participate in the
18 state retirement fund.

23 (d) This act
applies to governmental entities engaged
24 in an industrial classification
listed under subsection (a)

this section and to employees of governmental entities

engaged in or employed as the following:

4 (iii) State
employees;
while traveling, but only 5
when the travel occurs in the actual
performance of their 6
duties;

8 Section 2. W.S. 27-14-108(d)(iv),
(v) and (viii) is
9
repealed.

11 Section 3. This act is effective April 1, 2001.
