Controlled Substance Act-registrations.

A BILL
for
1 AN ACT relating to the
Controlled Substance Act; amending
2
procedures for suspension or revocation of registrations to
3
manufacture, distribute or dispense controlled substances
4
as specified; and providing for an effective date.

6 Be It Enacted by the Legislature of the State of Wyoming:
7
8 Section
1. W.S. 35-7-1026(a)(iv), (v), by creating a
9
new paragraph (vi) and by creating
new subsections (e) and
10 (f) is amended to read:
11
12 35-7-1026. Suspension or revocation of registration.
13
14 (a) A
registration under W.S. 35-7-1025 to
15 manufacture, distribute or dispense
a controlled substance

1 may
be suspended or revoked by the board upon a finding
2
that the registrant:
3
4 (iv) Has
willfully violated any of the
5
provisions of this act, or any rules and regulations
6
relating to controlled substances; or
7
8 (v) Has failed
to provide adequate security for
9
the storage of controlled substances to the extent that
10 repeated diversions have occurred;. or
11
12 (vi) Has voluntarily surrendered his license to
13 practice,
or has had his license revoked or suspended, or
14 the renewal thereof has been denied or lapsed for cause by
15 his professional licensing board.

17 (e) In the case of a revocation or suspension sought
18 by
the board's staff under paragraph (a)(ii), (iii) or (vi)
19 of this section, a copy of an order or other appropriate
20 documents from a court or administrative agency, certified
21 by the clerk, judge, secretary or executive director
22 thereof, evidencing a revocation, suspension, voluntary
23 suspension or conviction of a felony, shall be conclusive
24 evidence of the conviction, revocation or suspension of the

1 federal registration, or the loss of the license to
2 practice.

4 (f) The board, by
regulation, may adopt procedures
5 under which the denial, suspension,
revocation or denial of
6 renewal of a registration may be
resolved by mutual
7 agreement between the registrant or
applicant and the
8 board's staff, subject to prior
approval by the board.

10 Section 2. This act is effective July 1, 2001.
