Controlled Substance Act-amendments.

A BILL

 

for

 

 1  AN ACT relating to the Wyoming Controlled Substances Act;
 2  adding drugs to the schedule of drugs as specified;
 3  repealing a drug from the schedule of drugs; and providing
 4  for an effective date.

 5 

 6  Be It Enacted by the Legislature of the State of Wyoming:

 7 

 8         Section 1.  W.S. 35-7-1014(e) by creating a new
 9  paragraph (iii), 35-7-1018(c) by creating new paragraphs
10  (xiii) and (xiv), (g) by creating new paragraphs (xxvi)
11  through (xxviii) and by creating a new subsection (h) and
12  35-7-1020(c) by creating a new paragraph (xlix), (e) by
13  creating new paragraphs (xi) and (xii) and (f) by creating
14  a new paragraph (ii) are amended to read:

16         35-7-1014.  Substances included in Schedule I.

 2         (e)  Depressants.-Unless specifically excepted or
 3  unless listed in another schedule, any material compound,
 4  mixture or preparation which contains any quantity of the
 5  following substances having a depressant effect on the
 6  central nervous system, including its salts, isomers, and
 7  salts of isomers whenever the existence of such salts,
 8  isomers and salts of isomers is possible within the
 9  specific chemical designation:

11              (iii)  Gamma-hydroxybutyric (some other names
12  include GHB; gamma-hydroxybutyrate; 4-hydroxybutyrate; 4-
13  hydroxybutanoic acid; sodium oxybate; sodium oxybutyrate).

15         35-7-1018.  Substances included in Schedule III.

17         (c)  Depressants. -Unless specifically excepted or
18  listed in another schedule, any material, compound, mixture
19  or preparation which contains any quantity of the following
20  substances having a depressant effect on the central
21  nervous system:

 1              (xiii)  Ketamine, its salts, isomers and salts of
 2  isomers (some other names for ketamine include (±)-2-(2-
 3  chlorophenyl)-2-(methylamino)-cyclohexanone);

 4 

 5              (xiv)  Any drug product containing gamma
 6  hydoxybutyric acid, its salts, isomers and salts of
 7  isomers, for which an application is apporved under section
 8  505 of the federal Food, Drug and Cosmetic Act.

 9 

10         (g)  Anabolic steroids. - Unless specifically excepted
11  or unless listed in another schedule, any of the following
12  or any isomer, ester, salt or derivative of the following
13  that acts in the same manner on the human body:

14 

15              (xxvi)  Formebulone (formebolone);

16 

17              (xxvii)  Methenolone;

18 

19              (xxviii)  Any salt, ester or isomer of a drug or
20  substance described or listed in this paragraph, if that
21  salt, ester or isomer promotes muscle growth, except the
22  term does not include an anabolic steroid which is
23  expressly intended for administration through implants to
24  cattle or other nonhuman species and which has been

 1  approved by the United States secretary of health and
 2  humans services for such administration. If any person
 3  prescribes, dispenses or distributes such steroid for human
 4  use, the person shall be considered to have prescribed,
 5  dispensed or distributed an anabolic steroid within the
 6  meaning of this paragraph.

 7 

 8         (h)  Hallucinogenic substances:

 9 

10              (i)  Dronabinol (synthetic) in sesame oil and
11  encapsulated in a soft gelatin capsule in a United States
12  Food and Drug Administration approved drug product; some
13  other names for dronobinol include (6aR-trans)-6a,7,8,10a-
14  tetrahydro-6,6,9-trimethyl-3-pentyl-6H-dibenzo [b,d]pyran-
15  1-ol, or (-)-delta-9-(trans)-tetrahydrocannabinol.

17         35-7-1020.  Substances included in Schedule IV.

19         (c)  Depressants.-Unless specifically excepted or
20  unless listed in another schedule, any material, compound,
21  mixture or preparation which contains any quantity of the
22  following substances, including its salts, isomers and
23  salts of isomers whenever the existence of such salts,

 1  isomers and salts of isomers is possible within the
 2  specific chemical designation:

 3 

 4              (xlix)  Zaleplon.

 5 

 6         (e)  Stimulants.-Unless specifically excepted or
 7  unless listed in another schedule, any material, compound,
 8  mixture or preparation which contains any quantity of the
 9  following substances having a stimulant effect on the
10  central nervous system, including its salts, isomers and
11  salts of isomers:

13              (xi)  Sibutramine;

14 

15              (xii)  Modafinil.

16 

17         (f)  Other substances.-Unless specifically excepted
18  or unless listed in another schedule, any material,
19  compound, mixture or preparation which contains any
20  quantity of the following substances, including its salts:

21 

22              (ii)  Butorphanol (including its optical
23  isomers).

 1         Section 2.  W.S. 35-7-1016(g)(i) is repealed.

 2 

 3         Section 3.  This act is effective July 1, 2001.
