Game and fish-trapping license-4.

A BILL

 

for

 

 1  AN ACT relating to game and fish; modifying tagging and
 2  trapping requirements imposed upon licensed traps and
 3  snares; defining terms; granting rulemaking authority;
 4  increasing penalties; and providing for an effective date.

 5 

 6  Be It Enacted by the Legislature of the State of Wyoming:

 7 

 8         Section 1.  W.S. 23-2-303(a)(intro), (d) and (e) is
 9  amended to read:

10 

11         23-2-303.  Trapping licenses; tagging; traps and
12  snares; penalty; confiscation.

13 

14         (a)  Any person who has secured the approval of the
15  game warden in his district may, in the discretion of the
16  department upon application and the payment of the proper

 1  fee, receive a license to trap any furbearing animal. The
 2  department shall issue a trapping license to a nonresident
 3  only if his state issues licenses to Wyoming residents to
 4  trap the same species for which residents of that state may
 5  be licensed to trap in that state. Any nonresident applying
 6  for a Wyoming trapping license shall furnish:

 8         (d)  All steel leg hold traps and snares used for
 9  furbearing or predatory animals shall have metal tags
10  affixed thereto bearing be permanently marked or tagged
11  with the name and address of the owner or the
12  identification number assigned to the owner by the
13  department. Any identification number attached to a trap or
14  snare pursuant to this subsection is solely for the use of
15  the department or appropriate law enforcement officers and
16  is not a public record for purposes of W.S. 16-4-201
17  through 16-4-205. No trap or snare shall be set for
18  furbearing or predatory animals within thirty (30) feet of
19  any exposed bait or carcass over five (5) pounds in weight.
20  As used in this subsection, "exposed bait or carcass" means
21  the meat or viscera of any part of a mammal, bird or fish,
22  excluding dried bones. In addition, all snares used for
23  taking furbearing or predatory animals shall be equipped
24  with a break-away locking device that is designed to

 1  release at two hundred ninety-five (295) pounds of pressure
 2  or less and a snare loop not to exceed twelve (12) inches
 3  in diameter measured side to side. All steel leg hold traps
 4  excluding snares and quick kill body grip traps as defined
 5  by commission rule and regulation, shall be checked by the
 6  owner at least once during each seventy-two (72) hour
 7  period from the time the traps were set. excluding traps
 8  set underwater Quick kill body grip traps shall be checked
 9  by the owner not less than once each seven (7) day period
10  from the time the traps were set. All wildlife caught in
11  any trap or snare shall upon discovery, be removed
12  immediately by the owner.  Violation of this subsection
13  constitutes an eleventh a ninth degree misdemeanor.

15         (e)  Any steel leg hold trap or snare found in the
16  field not bearing the name and address of the owner of the
17  trap shall or snare or the identification number assigned
18  by the department to the owner of the trap or snare may be
19  confiscated by any employee of the department.

20 

21         Section 2.  This act is effective July 1, 2001.
