A BILL

 

for

 

 1  AN ACT relating to physician assistants; expanding
 2  membership on the board of medicine to include a physician
 3  assistant; conforming provisions; expanding the scope of
 4  practice of physician assistants as specified; and
 5  providing for an effective date.

 6 

 7  Be It Enacted by the Legislature of the State of Wyoming:

 8 

 9         Section 1.  W.S. 33-26-201(a), (c) and (e), 33-26-502
10  by creating a new subsection (c) and by renumbering (c) as
11  (d) and 33-26-510(c) are amended to read:

13         33-26-201.  State board of medicine; composition;
14  appointment; terms; qualifications; removal; vacancies;
15  quorum.

 1         (a)  The Wyoming state board of medicine shall consist
 2  of five (5) physicians licensed to practice medicine in
 3  Wyoming, one (1) of whom shall possess the degree of doctor
 4  of osteopathy, one (1) physician assistant and two (2)
 5  nonphysician members not directly related to physicians,
 6  appointed by the governor by and with the consent of the
 7  senate as required by W.S. 28-12-101 through 28-12-103.
 8  Board members appointed by the governor shall serve at the
 9  pleasure of the governor. The board members shall annually
10  elect a president and a vice-president.

12         (c)  Physician and physician assistant members shall
13  reside in and practice medicine in this state, and
14  nonphysician members shall reside in this state.

15 

16         (e)  A quorum of the board consists of five (5) six
17  (6) board members and shall have a nonphysician member
18  present.

22         (c)  Physician assistants are health care providers
23  and shall be considered health care providers for all
24  provisions of state law. Physician assistants shall be

 1  considered agents of their supervising physician in the
 2  performance of all practice related activities, including,
 3  but not limited to, the ordering of diagnostic, therapeutic
 4  and other medical services.

 5 

 6         (c)(d)  Nothing in this article shall be construed to
 7  conflict with or alter the provisions and requirements of
 8  W.S. 33-26-101 through 33-26-410.

 9 

10         33-26-510.  Prescription of drugs.

11 

12         (c)  A physician assistant may prescribe medications
13  only as an agent of the supervising physician. A physician
14  assistant shall not may prescribe schedule I and schedule
15  II through schedule V drugs as defined by W.S. 35-7-1013
16  through 35-7-1016. The supervising physician may delegate
17  authority to the physician assistant to dispense
18  prepackaged medications in rural clinics when pharmacy
19  services are not physically available. The board shall,
20  after consultation with the state board of pharmacy,
21  promulgate rules and regulations governing the prescription
22  of medications by a physician assistant.
