Law enforcement academy instructors.

A BILL

 

for

 

 1  AN ACT relating to Wyoming law enforcement academy;
 2  authorizing appointment and employment of peace officers as
 3  academy director and academy instructors; specifying peace
 4  officer authority; and providing for an effective date.

 5 

 6  Be It Enacted by the Legislature of the State of Wyoming:

 7 

 8         Section 1.  W.S. 6-1-104(a)(vi) by creating a new
 9  subparagraph (N), 7-2-101(a)(iv) by creating a new
10  subparagraph (M) and 9-1-633(a), (b) and by creating a new
11  subsection (n) are amended to read:

13         6-1-104.  Definitions.

14 

15         (a)  As used in W.S. 6-1-101 through 6-10-203 unless
16  otherwise defined:

 2              (vi)  "Peace officer" includes the following
 3  officers assigned to duty in the state of Wyoming:

 4 

 5                   (N)  Employees of the Wyoming law
 6  enforcement academy appointed or employed and acting
 7  pursuant to W.S. 9-1-633.

 9         7-2-101.  Definitions.

10 

11         (a)  As used in W.S. 7-2-101 through 7-2-105:

12 

13              (iv)  "Peace officer" means:

14 

15                   (M)  Employees of the Wyoming law
16  enforcement academy appointed or employed and acting
17  pursuant to W.S. 9-1-633.

18 

19         9-1-633.  Wyoming law enforcement academy; director;
20  appointment; term; qualifications; employees; salaries;
21  curriculum and training programs; fees; disposition.

23         (a)  A director of the Wyoming law enforcement academy
24  shall be appointed by the attorney general with the consent

 1  of the governor. The director shall serve at the pleasure
 2  of the attorney general. He shall have administrative and
 3  operational experience in criminal justice and such other
 4  qualifications as are satisfactory to the attorney general.
 5  In addition and subject to subsection (n) of this section,
 6  the attorney general may appoint a peace officer as
 7  director if qualified pursuant to W.S. 9-1-701 through
 8  9-1-707.

10         (b)  The director may employ assistants, teachers
11  instructors and other personnel as approved by the attorney
12  general with the consent of the governor. The director may,
13  subject to subsection (n) of this section, employ peace
14  officers as full-time instructors if qualified under W.S.
15  9-1-701 through 9-1-707.

17         (n)  Any employee of the Wyoming law enforcement
18  academy who is a peace officer qualified under W.S. 9-1-701
19  through 9-1-707 may perform as a peace officer:

21              (i)  When on property owned by or in the custody
22  of the state;

 1              (ii)  When providing security for state personnel
 2  or at designated state events or activities;

 3 

 4              (iii)  When providing security for designated
 5  individuals on or about state property; or

 6 

 7              (iv)  While responding to requests to assist
 8  other peace officers performing their official duties.

 9 

10         Section 2.  This act is effective July 1, 2001.
