Abuse reporting.

A BILL
for
1 AN ACT relating to
reporting of abuse; providing for the
2
reporting of abuse as specified; providing immunity; and
3
providing for an effective date.

5 Be It Enacted by the Legislature of the State of Wyoming:
6
7 Section 1. W.S. 35-20-103(a) is amended to read:
8
9 35-20-103. Reports of abuse, neglect or
exploitation
10 of disabled adult; reports maintained in
central registry.
11
12 (a) Any person
who knows or has reasonable cause to
13 believe or
suspect that a disabled adult has been or
is
14 being
abused, neglected, exploited or abandoned shall
15 immediately
report the facts to the sheriff's department,
16 the local police department or the
division. If a
person

1 reporting the
abuse or neglect is a member of the staff of
2 a medical or other public or private
institution, school,
3 facility or agency, he shall notify
the person in charge or
4 his designated agent as soon as possible,
who is thereupon
5 also responsible to make the report or
cause the report to
6 be made.Nothing
in this subsection is intended to relieve
7 individuals of their obligation to report on their own
8 behalf unless a report has already
been made or will be
9 made. Anyone whoAny person, official, institution or
10 agency
participating in good faith makes a report pursuant
11 to this section is immune from civil
or criminal liability
12 for that might otherwise result by reason of making
the
13 report. For
the purpose of any civil or criminal
14 proceeding, the good faith of any person, official,
15 institution or agency making the report pursuant to this
16 section shall be presumed.

18 Section 2. This act is effective July 1, 2001.
