requesting that Congress not introduce

or reintroduce threatened or endangered species into the

state of Wyoming without the express consent and approval
4
of the state of Wyoming and without providing for necessary
5
funding.

7 WHEREAS,
separation of powers is fundamental to the United
8
States Constitution and the power of the federal government
9
is strictly limited; and
10
11 WHEREAS, the state of Wyoming has certain
rights guaranteed
12 to the states by the Constitution of
the United States; and
13
14 WHEREAS, under the United States
constitution, the states
15 are to determine public policy; and

1 WHEREAS, traditionally
the state of Wyoming has
2
participated in issues regarding the introduction or
3
reintroduction of threatened or endangered species into
4
boundaries of the state; and
5
6 WHEREAS, the costs of
managing and conserving the
7
threatened or endangered species is significantly greater
8
than can be sustained through the annual operating budgets
9
of state agencies; and
10
11
WHEREAS, the introduction or reintroduction of threatened
12 or endangered species may have a
negative impact on the
13 state of Wyoming's industries and
economy; and
14
15
WHEREAS, the United States Congress should not make
16 decisions for the introduction or
reintroduction of
17 threatened or endangered species
into the state of Wyoming
18 without the consent and approval of
the state; and
19
20
WHEREAS, the United States Congress should not make
21 decisions for the introduction or
reintroduction of
22 threatened or endangered species
into the state of Wyoming
23 without providing necessary funding
for the management and
24 conservation of these species.

2 Now, Therefore, Be It Resolved By The
Members of the
3
Legislature of the State of Wyoming, a majority
of all the
4
members of each house, voting separately, concurring
5
therein:
6
7 Section 1. That
the Wyoming State Legislature does
8
not condone the introduction of threatened or endangered
9
species pursuant to the federal "Endangered Species Act of
10 1973" 16 U.S.C. § 1531, et
seq., as amended, into the state
11 of Wyoming without the approval and
consent of the state of
12 Wyoming.

14 Section
2. That the Wyoming State Legislature
15
encourages the United States Congress to appropriate monies
16 for the management and conservation
of threatened or
17 endangered species prior to their
introduction or
18 reintroduction into the state of
Wyoming.

3. That
the Secretary of State of Wyoming
2
transmit copies of this resolution to the President of the
3
United States, to the President of the Senate and the
4
Speaker of the House of Representatives of the United
5
States Congress, to the United States Secretary of Interior
6
and the United States Secretary of Agriculture and to the
7
Wyoming Congressional Delegation.
