A BILL

 

for

 

 1  AN ACT relating to public records; providing exceptions for
 2  information obtained through the Wyoming natural diversity
 3  database under the Public Records Act as specified; and
 4  providing for an effective date.

 5 

 6  Be It Enacted by the Legislature of the State of Wyoming:

 7 

 8         Section 1.  W.S. 16-4-203 by creating a new subsection
 9  (h) is amended to read:

10 

11         16-4-203.  Right of inspection; grounds for denial;
12  access of news media; order permitting or restricting
13  disclosure; exception.

15         (h)  Notwithstanding any other provision of this
16  section, the following applies to the Wyoming natural

 1  diversity database located at the University of Wyoming and
 2  any report prepared by the custodian from that database:

 3 

 4              (i)  The custodian may charge a reasonable fee
 5  for searching the database and preparing a report from that
 6  database information;

 7 

 8              (ii)  The custodian shall allow the inspection of
 9  all records in the database at a level of spatial precision
10  equal to the township, but at no more precise level;

11 

12              (iii)  Research reports prepared by the custodian
13  funded completely from nonstate sources are subject to
14  paragraph (b)(iii) of this section;

15 

16              (iv)  Any record contained in the database
17  pertaining to private land shall not be released by the
18  University of Wyoming without the prior written consent of
19  the landowner.  Nothing in this paragraph prohibits the
20  release of any information which would otherwise be
21  available from any other information source available to
22  the public if the original source is cited.

 1         Section 2.  This act is effective immediately upon
 2  completion of all acts necessary for a bill to become law
 3  as provided by Article 4, Section 8 of the Wyoming
 4  Constitution.
