A BILL
for
1 AN ACT relating to
medication aides and assistants;
2
authorizing medication aides and assistants to perform
3
duties as specified; providing definitions; granting rule
4
making authority to the board of nursing as specified;
5
sunsetting rules as specified; and providing for an
6
effective date.

8 Be It Enacted by the Legislature of the State of Wyoming:
9
10 Section 1. W.S. 33-21-120(a) by creating new
11 paragraphs (xii) and (xiii) and by
renumbering (xii) as
12 (xiv) and 33-21-122(b) and (c) by
creating new paragraphs
13 (xxiv) and (xxv) and by creating a
new subsection (f) are
14 amended to read:

2 (a) As used in this act:
3
4 (xii) "Medication
aides" means certified nursing
5 assistants/nurse aides who have met
the additional
6 educational and certification
standards established by the
7 board to perform the function of
medication administration,
8 except in a licensed acute care
setting as defined in W.S.
9 35-2-901, under the direction or
supervision, as defined by
10 the board, of a registered nurse;
11
12 (xiii) "Medication assistant" means unlicensed
13 assistive
personnel who have met the educational standards
14 established by the board to perform the function of
15 medication administration, except in a
licensed acute care
16 setting as
defined in W.S. 35-2-901, a licensed nursing
17 care facility or a licensed assisted living facility under
18 the direction, as
defined by the board, of a registered
19 nurse.
"Medication assistant" shall not include a certified
20 public school teacher who refuses to obtain the necessary
21 training to become a medication assistant. No school
22 district shall take any disciplinary action against any
23 certified public school teacher who refuses to take the
24 necessary training to become a medication assistant;

5 33-21-122. Board of nursing; powers and duties.

7 (b) The board of nursing may make, adopt, amend,
8
repeal and enforce reasonable rules and regulations
9
necessary for the proper administration and enforcement of
10 this act. Unless specifically reauthorized by the
11 legislature
prior to July 1, 2005, rules and regulations
12 promulgated under paragraph (c)(xxiv) of this section prior
13 to July 1, 2005, shall on and after July 1, 2005, be null
14 and void and of no effect and shall not be enforceable.

16 (c) Without
limiting the foregoing, the board of
17 nursing may do the following:
18
19 (xxiv) By board rule and regulation, prescribe:
20
21 (A) Uniform and reasonable standards for
22 medication
administration by medication aides and
23 medication assistants;

1 (B) Reasonable educational
standards
2 applicable to medication aides and
assistants;
3
4 (C) Reasonable qualifications,
5 certification, recertification,
examination, practice,
6 continuing competencies and discipline
of medication aides.

8 (xxv) Set a fee for
certification,
9 recertification or examination of
medication aides or
10 assistants.
11
12 (f) Medication aides may administer medications in an
13 assisted
living facility as defined by W.S. 35-2-901, when
14 the board of nursing has approved a plan or protocol for
15 administration of medication specific to that facility.

17 Section 2. This act is effective July 1, 2001.
