Industrial road program-amendments.

A BILL
for
1 AN ACT relating to the
industrial road program; increasing
2
the amount set aside for the program by the transportation
3
commission as specified; increasing the cap on county match
4
for the program as specified; and providing for an
5
effective date.

7 Be It Enacted by the Legislature of the State of Wyoming:

9 Section
1. W.S. 24-5-118 and 24-5-119 are amended to
10 read:
11
12 24-5-118. Industrial road program account.
13
14 The transportation commission shall set
aside and
15 appropriate out of funds in their
possession or under their
16 control, not otherwise appropriated,
the sum of one million

1 dollars ($1,000,000.00) four million dollars
2 ($4,000,000.00) at the
beginning of each biennium to be
3
placed in an account known as the industrial road program
4
account within the highway fund. All funds not used during
5
each biennium shall lapse and be returned to the general
6
account of the highway fund.

8 24-5-119. Counties to match state
funds; maximum
9 amount
of county expenditures; exception; acquisition of
10 right-of-way.

12 Any county participating in the industrial
road program
13 shall match money equally with money
set aside pursuant to
14 W.S. 24-5-118. These funds may be
derived from any funds in
15 the respective county budget now
available or any monies
16 which may subsequently be budgeted
for this program,
17 provided, however, no county shall
expend on this program
18 in excess of two hundred thousand dollars ($200,000.00) one
19 million dollars ($1,000,000.00) each and every
biennium.
20 This act shall not apply to any
project having a total cost
21 of less than fifty thousand dollars
($50,000.00) total. The
22 board of the county commissioners of
each county shall
23 acquire the right-of-way for any
industrial road, the

of which shall be charged against the industrial

road program.

4 Section 2. This act is effective July 1, 2001.
