A BILL

 

for

 

 1  AN ACT relating to railroads; requiring trains to be
 2  operated by a specified crew as specified; and providing
 3  for an effective date.

 4 

 5  Be It Enacted by the Legislature of the State of Wyoming:

 6 

 7         Section 1.  W.S. 37-9-506 is created to read:

 8 

 9         37-9-506.  Railroad train crews; one crew person or
10  crewless train authorization.

11 

12         (a)  Notwithstanding any other provision of law, no
13  crewless or one (1) crew person freight or passenger train
14  may be operated between terminals in this state without the
15  express written authorization of the federal railroad
16  administration of the United States department of

 1  transportation and subsequent written notice to the Wyoming
 2  department of transportation.

 3 

 4         (b)  The provisions of this section shall not apply
 5  to:

 6 

 7              (i)  The extent they are contrary to or
 8  inconsistent with a regulation or order of the federal
 9  railroad administration of the United States department of
10  transportation; or

11 

12              (ii)  Railroad trains operating on property not
13  owned by railroad companies and using contract crews; or

14 

15              (iii)  Railroad trains operating for not more
16  than ten (10) miles, terminal to terminal.

17 

18         Section 2.  This act is effective July 1, 2001.
