A BILL

 

for

 

 1  AN ACT relating to workers' compensation; amending the
 2  permanent total disability and death benefit awarded to
 3  children under the workers' compensation program as
 4  specified; and providing for an effective date.

 5 

 6  Be It Enacted by the Legislature of the State of Wyoming:

 7 

 8         Section 1.  W.S. 27-14-403(b) is amended to read:

 9 

10         27-14-403.  Awards generally; method of payment.

11 

12         (b)  Notwithstanding the date of death or the date of
13  the determination of permanent total disability,
in the
14  case of permanent total disability or death, each child of
15  an employee shall be paid one hundred dollars ($100.00) one
16  hundred fifty dollars ($150.00) per month for payments made

 1  after July 1, 2001, until the child dies or reaches the age
 2  of majority, whichever first occurs, or if the child is
 3  physically or mentally incapacitated until the child dies
 4  or attains the age of twenty-one (21) years, whichever
 5  first occurs. The amount awarded under this subsection
 6  shall be adjusted for inflation annually by the division,
 7  using the consumer price index of the United States
 8  department of labor, bureau of labor statistics.

 9 

10         Section 2.  This act is effective July 1, 2001.
