A BILL

 

for

 

 1  AN ACT relating to public lands; modifying emergency fire
 2  suppression account balance levels for purposes of imposing
 3  assessments; modifying assessments to participate in the
 4  account; and providing for an effective date.

 5 

 6  Be It Enacted by the Legislature of the State of Wyoming:

 7 

 8         Section 1.  W.S. 36-1-404(d) and (e) is amended to
 9  read:

10 

11         36-1-404.  Participation by counties; assessments;
12  withdrawal from participation; forfeiture of assessments
13  for failure to pay assessments.

15         (d)  In the event the balance in the account exceeds
16  one million dollars ($1,000,000.00) three million dollars
17  ($3,000,000.00) on July 1 in any year, no assessment will

 1  shall be charged to participating counties for that fiscal
 2  year or for any subsequent year until the balance in the
 3  account is reduced to an amount less than eight hundred
 4  thousand dollars ($800,000.00) two million four hundred
 5  thousand dollars ($2,400,000.00) in which event assessments
 6  will shall again be charged to participating counties
 7  beginning in the following fiscal year.

 8 

 9         (e)  Any county electing to participate in the account
10  in any year after July 1, 1987 may become a participating
11  county by paying an initial assessment equal to the annual
12  assessment computed for that county under subsection (b) of
13  this section times the greatest number of years any other
14  participating county has paid annual assessments into the
15  account multiplied by three (3).

17         Section 2.  This act is effective July 1, 2001.
