for

 

 1  AN ACT relating to public schools; requiring school
 2  districts to implement a reading assessment for first and
 3  second grade students; requiring demonstration of
 4  proficiency; requiring remediation programs; providing
 5  payments to districts from the foundation program account;
 6  providing an appropriation; specifying application; and
 7  providing for an effective date.

 9  Be It Enacted by the Legislature of the State of Wyoming:

11         Section 1.  W.S. 21-3-301 is created to read:

 1         (a)  Each school district shall design and implement a
 2  reading screening program that measures student reading
 3  progress in grades one (1) and two (2). The screening
 4  program shall be designed by each school district aligned
 5  to the statewide educational program standards and shall
 6  specifically screen for student performance in reading at
 7  grades one (1) and two (2).

 9         (b)  Students not screening successfully shall be
10  assessed to identify the specific reading problem and
11  determine its nature. Students not showing appropriate
12  reading competence shall be placed on an individualized
13  reading plan to remedy the reading related difficulty. For
14  students under an individualized education program (IEP),
15  the IEP shall be deemed sufficient to meet the requirements
16  of this subsection and no additional plan shall be
17  required. For school year 2002-2003 and each school year
18  thereafter, each district shall annually report to the
19  department of education on the progress toward reaching the
20  goal of seventy percent (70%) of identified students being
21  reading proficient. The report shall include longitudinal
22  data on all students in grades one (1) through four (4)
23  identified for intervention. If the goal is not reached,
24  the district shall report the reason the goal was not

 1  reached and the steps being taken by the district to solve
 2  the problem.

 4         Section 2.  W.S. 21-3-110(a) by creating a new
 5  paragraph (xxii) is amended to read:

 6 

 7         21-3-110.  Duties of boards of trustees.

 8 

 9         (a)  The board of trustees in each school district
10  shall:

11 

12              (xxii)  Implement and administer the reading
13  screening program for students in grades one (1) and two
14  (2) as required by W.S. 21-3-301.

16         Section 3.

18         (a)  For school year 2001-2002, the state department
19  shall pay from the foundation program account an amount to
20  each district determined by multiplying one hundred
21  sixty-seven dollars ($167.00) by the average daily
22  membership (ADM) in kindergarten through grade two (2). For
23  purposes of this subsection and notwithstanding W.S.
24  21-13-309(q), the average daily membership (ADM) for each

 1  district's kindergarten through grade two (2) students
 2  shall be computed based upon the prior year ADM. In
 3  addition and notwithstanding W.S. 21-13-309(s), the ADM for
 4  each district's kindergarten students shall not be divided
 5  by two (2). Payments computed under this subsection shall
 6  be used by districts to implement the screening assessment
 7  and intervention required under section 1 of this act.

 9         (b)  The payment computed pursuant to subsection (a)
10  of this section shall be made by the department on or about
11  October 15, 2001.

13         Section 4.  No school district shall be required to
14  comply with this act during the 2000-2001 school year. 
15  Nothing in this act prohibits any school district from
16  voluntarily implementing portions of this act during the
17  2000-2001 school year.

19         Section 5.  This act is effective July 1, 2001.
