AN ACT relating to physician assistants; expanding
membership on the board of medicine to include a physician
assistant; conforming provisions; expanding the scope of
practice of physician assistants as specified; and
providing for an effective date.

 

Be It Enacted by the Legislature of the State of Wyoming:

 

Section 1.  W.S. 33-26-201(a), (c) and (e), 33-26-502
by creating a new subsection (c) and by renumbering (c) as
(d) and 33-26-510(c) are amended to read:

 

33-26-201.  State board of medicine; composition;
appointment; terms; qualifications; removal; vacancies;
quorum.

 

(a)  The Wyoming state board of medicine shall consist
of five (5) physicians licensed to practice medicine in
Wyoming, one (1) of whom shall possess the degree of doctor
of osteopathy, one (1) physician assistant and two (2)
nonphysician members not directly related to physicians,
appointed by the governor by and with the consent of the
senate as required by W.S. 28-12-101 through 28-12-103.
Board members appointed by the governor shall serve at the
pleasure of the governor. The board members shall annually
elect a president and a vice-president.

 

(c)  Physician and physician assistant members shall
reside in and practice medicine in this state, and
nonphysician members shall reside in this state.

 

(e)  A quorum of the board consists of five (5) six
(6)
board members and shall have a nonphysician member
present.

33-26-502.  Scope of W.S. 33-26-501 through 33-26-511.

 

(c)  Physician assistants are health care providers
and shall be considered health care providers for all
provisions of state law. Physician assistants shall be
considered agents of their supervising physician in the
performance of all practice related activities, including,
but not limited to, the ordering of diagnostic, therapeutic
and other medical services.

 

(c)(d)  Nothing in this article shall be construed to
conflict with or alter the provisions and requirements of
W.S. 33-26-101 through 33-26-410.

 

33-26-510.  Prescription of drugs.

 

(c)  A physician assistant may prescribe medications
only as an agent of the supervising physician. A physician
assistant shall not may prescribe schedule I and schedule
II through schedule V drugs as defined by W.S. 35-7-1013
35-7-1015 through 35-7-1016 35-7-1022. The supervising
physician may delegate authority to the physician assistant
to dispense prepackaged medications in rural clinics when
pharmacy services are not physically available. The board
shall, after consultation with the state board of pharmacy,
promulgate rules and regulations governing the prescription
of medications by a physician assistant.

Section 2.  This act is effective July 1, 2001.
