GENERAL SESSION
AN ACT relating to the authority of the Wyoming community
development authority to finance care facilities; modifying
definition of care facilities; providing authority to
finance care facilities as specified; conforming current
provisions and providing additional bonding authority; and
providing for an effective date.
Be It Enacted
by the Legislature of the State of Wyoming:
Section 1. W.S. 9-7-102(a)(ii), 9-7-103(a)(viii), (x)
and (xi), 9-7-105(a) by creating a new paragraph (xxii) and
9-7-108 by creating a new subsection (j) are amended to
read:
9-7-102. Legislative findings.
(a) It is
declared that:
(ii) It is in
the public interest of the
citizens of this state to promote the economic welfare of
the state and its residents by increasing employment,
stimulating economic activity, augmenting sources of tax
revenue, fostering economic stability, furthering
health
care and improving the balance of the state's economy;
9-7-103. Definitions.
(a) As used in
this act:
(viii) "Intermediate Care
facility" means a any governmental or
nonprofit hospital and
facility licensed or regulated by the state or a
municipality or other political subdivision in which the
facility is located for the accommodation of persons who
because of incapacitating infirmities require minimum but
continuous care

may include any land, building, other improvements or
equipment and all real and personal, tangible or
intangible, property in connection therewith, or any
interest therein or combination thereof;
(x) "Project"
means a care facility or a
specific residential housing project including lands,
any land,
building, other
buildings, improvements, real and personal properties or
any interest therein or any combination thereof, an
intermediate care facility
improvements or equipment and all real and personal,
tangible or intangible, property in connection therewith,
or any interest therein or combination thereof, or any
portion of a project;
(xi) "Project
cost" means the sum total of costs
which the authority deems necessary for financing and
carrying out a housing project;
9-7-105. Community development
authority; general
powers and duties.
(a) For the
purposes of this act, the authority may:
(xxii) Make loans to
mortgage lenders to finance
projects, including construction loans and advances, under
terms and conditions, and with security therefore, as the
authority deems appropriate.
9-7-108. Community development
authority; revenue
bonds; amount authorized.
(j) In addition to the
bonds authorized by subsection
(h) of this section, the authority may issue and have
outstanding additional bonds for care facility projects in

an aggregate amount of up to two hundred fifty million
dollars ($250,000,000.00).
Section 2. This act is effective immediately upon
completion of all acts necessary for a bill to become law
as provided by Article 4, Section 8 of the Wyoming
Constitution.
