GENERAL SESSION
AN ACT relating to crimes
and offenses; modifying
aggravating
circumstance for death penalty purposes; and
providing for an
effective date.
Be It Enacted
by the Legislature of the State of Wyoming:
Section 1. W.S. 6-2-102(h)(viii) is amended to read:
6-2-102. Presentence hearing for
murder in the first
degree;
mitigating and aggravating circumstances; effect of
error in
hearing.
(h) Aggravating
circumstances are limited to the
following:
(viii) The murder
of a judicial officer, former
judicial officer,
district attorney, former district
attorney, defending
attorney, peace officer, juror or
witness, during or
because of the exercise of his official
duty or because of the victim's former or present official
status;

Section 2. This act is effective immediately upon
completion of all acts
necessary for a bill to become law
as provided by Article
4, Section 8 of the Wyoming
Constitution.
