AN ACT relating to peace
officers; clarifying the
definition of
livestock board investigators and brand
inspectors as
peace officers as specified; and providing
for an effective
date.
Be It Enacted
by the Legislature of the State of Wyoming:
Section 1. W.S. 6-1-104(a)(vi)(F)
and
7-2-101(a)(iv)(E) are amended to read:
6-1-104. Definitions.
(a) As used in
W.S. 6-1-101 through 6-10-203 unless
otherwise defined:
(vi) "Peace
officer" includes the following
officers assigned to
duty in the state of Wyoming:
(F) Investigators and brand inspectors
of
the Wyoming livestock
board authorized under W.S. 11-20-201 who have
qualified pursuant to W.S. 9-1-701 through 9-1-707
when:
(I) Enforcing
W.S. 11-19-101 through 6-3-201, 6-3-203,
11-24-115 and 11-29-101
through 11-30-113
6-3-401 through 6-3-403, 6-3-407, 6-3-410, 6-3-601 through
6-3-603, 6-3-607, 6-3-610 through 6-3-612, 6-9-202,
35-10-101, 35-10-102 and 35-10-104, the provisions of title
11 and any laws prohibiting
theft or mutilation of
livestock or any part
thereof and any rule or regulation
promulgated by the
Wyoming livestock board or any other law
for which they are
granted statutory enforcement authority;

(II) Responding to a
request to assist
another peace officer
as defined in this paragraph
performing his
official duty; or
(III) Enforcing a valid
arrest warrant
for a crime specified
in subdivision (F)(I) of this
paragraph.
7-2-101. Definitions.
(a) As used in
W.S. 7-2-101 through 7-2-105:
(iv) "Peace
officer" means:
(E) Investigators and brand inspectors
of
the Wyoming livestock
board authorized under W.S. 11-18-101 who have
through 11-18-113 and
11-20-201 or duly authorized
investigators of the
Wyoming livestock board
qualified pursuant to
W.S. 9-1-701 through 9-1-707:
(I) When enforcing
W.S. 11-19-101 6-3-201,
through 11-24-115 and
11-29-101 through 11-30-113
6-3-203, 6-3-401 through 6-3-403, 6-3-407, 6-3-410, 6-3-601
through 6-3-603, 6-3-607, 6-3-610 through 6-3-612, 6-9-202,
35-10-101, 35-10-102 and 35-10-104, the provisions of title
11 and any laws prohibiting
theft, killing or mutilation of
livestock or any part
thereof and any rule or regulation
promulgated by the
Wyoming livestock board or any other law
for which they are
granted statutory enforcement authority;
(II) When responding to
a request to
assist another peace
officer as defined in this paragraph
performing his
official duty; or

(III) Enforcing a valid

for a crime specified
in subdivision (E)(I) of this
paragraph.
Section 2. This act is effective July 1, 2001.
