ENROLLED ACT NO. 27,  SENATE

 

FIFTY-SIXTH LEGISLATURE OF THE STATE OF WYOMING

2001 GENERAL SESSION

 

 

 

 

AN ACT relating to school capital construction;
establishing a select committee on capital construction as
specified; prescribing duties; requiring a report;
providing an appropriation; and providing for an effective
date.

 

Be It Enacted by the Legislature of the State of Wyoming:

 

Section 1.

 

(a)  There is created the select committee on school
capital construction consisting of the following members:

 

(i)  Five (5) members of the Wyoming senate
appointed by the president of the senate subject to the
following:

 

(A)  Not more than two (2) of whom shall be
members of the senate education committee;

 

(B)  At least one (1) but not more than two
(2) of whom shall be members of the senate appropriations
committee; and

 

(C)  Not more than three (3) of whom shall
be from the same political party.

 

(ii)  Five (5) members of the Wyoming house of
representatives appointed by the speaker of the house of
representatives subject to the following:

 

(A)  Not more than two (2) of whom shall be
members of the house education committee;

(B)  At least one (1) but not more than two
(2) of whom shall be members of the house appropriations
committee; and

 

(C)  Not more than three (3) of whom shall
be from the same political party.

 

(b)  The president of the senate and the speaker of
the house of representatives shall each appoint a
cochairman of the select committee. The committee may
contract with consultants as necessary. Staff services to
the committee shall be provided by the legislative service
office.

 

(c)  The select committee shall review the school
capital construction program established under W.S.
21-15-105 through 21-15-112 and make recommendations to the
legislature on a revised program which may include:

 

(i)  A three (3) phase process for consideration
of individual school district capital construction projects
that both address identified school building and facility
needs and require state assistance to complete required
construction, where:

 

(A)  Phase one (1) consists of a review of
the building or facility need as identified by the
statewide needs assessment pursuant to W.S. 21-15-107(b),
and the relationship of the proposed method to address the
building need to the scores contained within the needs
assessment;

 

(B)  Phase two (2) consists of the
development of planning and other schematic design
documents and an independent professional review and
analysis of the plans and documents, with recommendations

available for purposes of subparagraph (i)(C) of this
subsection;

 

(C)  Phase three (3) consists of legislative
review of findings and recommendations developed under
subparagraph (i)(B) of the subsection and the development
of project funding, including future monitoring and
reporting of project development.

 

(ii)  A process for the provision of emergency
assistance for district's experiencing bona fide emergency
building and facility needs, subject to legislative review;

 

(iii)  Funding for school capital construction
needs.

 

(d)  In addition to subsection (c) of this section,
the select committee shall address any matter resulting
from court decisions with respect to currently pending
cases regarding school capital construction which requires
legislative action.

 

(e)  The select committee shall report to the
legislature not later than February 1, 2002, on
recommendations developed under subsections (c) and (d) of
this section, together with necessary legislation
implementing committee recommendations. The select
committee may introduce legislation as other committees of
the legislature.

 

(f)  Fifty thousand dollars ($50,000.00) is
appropriated from the general fund to the legislative
service office to implement this act. Expenditures shall be
made only with the approval of the select committee.

Section 2.  This act is effective immediately upon
completion of all acts necessary for a bill to become law
as provided by Article 4, Section 8 of the Wyoming
Constitution.
