Seed laboratory.

for

 

AN ACT relating to agriculture and animals; providing for the location and name of a seed analysis laboratory as specified; providing appropriations; providing for personnel; modifying the selection of a state seed analyst; requiring a report; and providing for an effective date.

 

Be It Enacted by the Legislature of the State of Wyoming:

 

Section 1.  W.S. 11-12-115 is amended to read:

 

11-12-115.  State seed analyst; seed laboratory.

 

(a)  The board of agriculture shall operate a state seed laboratory through a memorandum of understanding with the university of Wyoming.  The terms and conditions of the memorandum of understnding shall include the designation and compensation of a state seed analyst shall be selected by the board.  The analyst shall receive a salary fixed by the human resources division of the department of administration and information, paid by the state from an appropriation for that purpose

 

(b)  A state laboratory operated for the purposes of seed analysis shall be located in Park County and shall be known as the Denny J. Smith Memorial Seed Analysis Laboratory.

 

Section 2.

(a)  There is appropriated from the budget reserve account to the department of agriculture:

 

           (i)  Three hundred thirteen thousand dollars ($313,000.00) for the purposes of constructing a seed laboratory in Park County;

 

           (ii)  Sixty-nine thousand dollars ($69,000.00) for equipping and selecting a seed analyst for a seed laboratory in Park County.

 

(b)  There is appropriated one hundred fifty-seven thousand five hundred dollars ($157,500.00) from the general fund to the department of agriculture for the purposes of operation of the laboratory not later than the fiscal year commencing July 1, 2003.

 

     (c)  The department of agriculture is authorized to contract with the University of Wyoming for constructing, equipping, selecting personnel and operating the seed laboratory for the department subject to mutually agreeable terms and conditions.

 

Section 3.  The department of agriculture shall provide a report detailing the activities and the overall effectiveness of the laboratory to the governor and the members of the joint agriculture, public lands and water resources interim committee on or before December 31, 2005.

 

Section 4.  This act is effective immediately upon completion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constitution.
