Introduction of species.

A BILL

 

for

 

 1  AN ACT relating to animals; prohibiting the introduction or
 2  reintroduction of species into the state as specified;
 3  providing a penalty; amending related provision; and
 4  providing for an effective date.

 5 

 6  Be It Enacted by the Legislature of the State of Wyoming:

 7 

 8        Section 1.  W.S. 23-1-108 is created to read:

 9 

10        23-1-108.  Introduction or reintroduction of species;
11  penalty.

12 

13        (a)  No species shall be introduced or reintroduced
14  into this state through action by any person or any state
15  or local governmental entity, unless and until the
16  legislature acts by bill to specifically name the species

 1  and to specify the manner of introduction or
 2  reintroduction. No species shall be introduced or
 3  reintroduced unless the species is:

 4 

 5            (i)  Not found or no longer found in this state;
 6  and

 7 

 8            (ii)  A candidate for listing or has been placed
 9  on the threatened or endangered species list pursuant to
10  the federal "Endangered Species Act of 1973", 16 U.S.C. §
11  1531, et seq., as amended.

13        (b)  Any person who violates this section shall be
14  guilty of a first degree misdemeanor punishable as provided
15  by W.S. 23-6-202.

17        (c)  Nothing in this section shall prohibit the
18  introduction or reintroduction of species which:

19 

20            (i)  Is not a candidate for listing on the
21  threatened or endangered species list pursuant to the
22  federal Endangered Species Act, 16 U.S.C. § 1531, et seq.,
23  as amended; or

 1            (ii)  Has not been placed on the threatened or
 2  endangered species list pursuant to the federal Endangered
 3  Species Act, 16 U.S.C. § 1531, et seq., as amended.

 5        Section 2.  W.S. 23-1-302(a)(xxvi) is amended to read:

 6 

 7        23-1-302.  Powers and duties.

 8 

 9        (a)  The commission is directed and empowered:

10 

11            (xxvi)  Subject to the provisions of W.S.
12  23-1-108, to regulate or prohibit the importation of exotic
13  species, small game animals, furbearing animals, protected
14  animals, game birds, migratory birds, protected birds, and
15  fish into Wyoming, and to regulate and permit the
16  importation of big or trophy game animals into Wyoming only
17  for exhibition purposes or for zoos; and

18 

19        Section 3.  This act is effective immediately upon
20  completion of all acts necessary for a bill to become law
21  as provided by Article 4, Section 8 of the Wyoming
22  Constitution.
