School finance-external cost adjustment.

A BILL

 

for

 

 1  AN ACT relating to school finance; modifying the amount of
 2  and basis for computing the external cost adjustment;
 3  restricting school district expenditure as specified; and
 4  providing for an effective date.

 5 

 6  Be It Enacted by the Legislature of the State of Wyoming:

 7 

 8         Section 1.  W.S. 21-13-309(o)(i)(A)(I) is amended to
 9  read:

10 

11         21-13-309.  Determination of amount to be included in
12  foundation program for each district.

13 

14         (o)  The revised model amount per ADM for each
15  district computed under subsection (n) of this section
16  shall be further adjusted for the following. Unless
17  otherwise specified in this subsection, the adjustments

 1  under this subsection shall be determined as specified in
 2  the cost of education study, dated April 1997, and the
 3  spreadsheet provided by the consultant performing the study
 4  related thereto, both of which are on file in the
 5  legislative service office:

 6 

 7              (i)  The amount shall be adjusted to provide for
 8  the effects of inflation as follows:

 9 

10                   (A)  For the 2001-2002 school year, increase
11  the amount by a total percentage of:

12 

13                         (I)  One and three-tenths percent
14  (1.3%), for inflation Fourteen and forty-three hundredths
15  percent (14.43%) for that school year; plus

16 

17         Section 2.  Notwithstanding W.S. 21-13-309 through
18  21-13-331, and effective for school year 2001-2002 only,
19  the state superintendent shall not distribute that portion
20  of entitlements to districts from the foundation program
21  account under W.S. 21-13-313, nor determine that portion of
22  recapture payments under W.S. 21-13-102, which is
23  attributable to the external cost adjustment computed under
24  W.S. 21-13-309(o), until the district board of trustees

 1  certifies in writing to the state superintendent that
 2  expenditure of specific amounts computed for that district
 3  under the external cost adjustment pursuant to W.S.
 4  21-13-309(o) shall be restricted to salary adjustments.

 5 

 6         Section 3.  This act is effective July 1, 2001.
