State parks-amendments.

A BILL

 

for

 

 1  AN ACT relating to state parks; requiring the department of
 2  state parks and cultural resources to set hours of
 3  operation for bathhouses located in Hot Springs State Park;
 4  modifying limits on Hot Springs State Park campground fees;
 5  eliminating the state parks advisory board; imposing a
 6  moratorium upon loans issued by the state loan and
 7  investment board for facilities at Hot Springs State Park;
 8  and providing for effective dates.

10  Be It Enacted by the Legislature of the State of Wyoming:

11 

12         Section 1.  W.S. 36-8-304 is amended to read:

13 

14         36-8-304.  Public baths; public campgrounds; lease of
15  park lands.

 1         (a)  The department of state parks and cultural
 2  resources shall retain one-fourth (1/4) of the water in the
 3  main or largest principal spring on the state land on the
 4  eastern bank of the Big Horn River with sufficient quantity
 5  of the land adjacent thereto, upon which suitable
 6  bathhouses may be constructed, which shall be open, with
 7  preference of use given free to persons who are indigent
 8  and suffering from ailments for which bathing in the waters
 9  of the Big Horn Hot Springs will afford relief. The
10  department may make necessary rules and regulations
11  governing free baths, the manner and time of bathing, and
12  may require medical examination of applicants for baths.
13  The bathhouse shall remain open not less than ten (10)
14  hours a day each weekday and not less than six (6) hours on
15  Sundays and holidays and in consultation with the
16  commission, shall establish the hours of bathhouse
17  operation.

19         (b)  The department, in consultation with the
20  commission, may set apart a suitable location and portion
21  of the lands for public camping purposes but may contract
22  for operation of any campgrounds by competitive sealed bid.

 1  Springs State Park, the charges per night shall not be less
 2  than one-half (1/2) of the average charges imposed by
 3  private campground operators within a five (5) mile radius
 4  of the Hot Springs State Park.

 6         (c)  The balance of the water and lands may be leased
 7  by the department, in consultation with the commission, for
 8  a term not less than five (5) years nor longer than
 9  ninety-nine (99) years. The length of the term of each
10  individual lease shall be determined by the department, in
11  consultation with the commission, in accordance with the
12  value of the improvements proposed and actually placed upon
13  the leasehold. The department may by rule provide for
14  special use permits for limited purposes. The department
15  may make adopt rules and regulations with respect to for
16  the erection of buildings and improvements upon the
17  individual leaseholds and may prescribe the plans and
18  specifications of, and the materials to be used in the
19  buildings to be erected. The department, in consultation
20  with the commission, mayin any lease may provide for such
21  plans and buildings and such building use thereof as will
22  best carry out the purposes of this chapter in retaining
23  which best retains the lands and waters thereon within the

 1  park for the treatment and cure of diseases and the
 2  pleasure of the general public.

 3 

 4         (d)  The department, in consultation with the
 5  commission, may conduct through pipes or otherwise, any
 6  portion of the waters of the hot springs reserved for free
 7  use under subsection (a) of this section, and to provide
 8  for providing other baths and bathhouses for the use of the
 9  water at such rental or rates as it prescribes.

11         Section 2.  W.S. 36-4-102 is repealed.

13         Section 3.  On and after the effective date of this
14  section, the state loan and investment board shall not
15  issue loans authorized under W.S. 36-8-318 through 36-8-320
16  for purposes of improving and upgrading business
17  enterprises and guest accommodations at Hot Springs State
18  Park. Nothing in this section shall in any manner affect or
19  invalidate any loan nor the terms or conditions of any loan
20  issued under W.S. 36-8-318 through 36-8-320 prior to the
21  effective date of this act.

23         Section 4.

 1         (a)  Section 3 of this act is effective immediately
 2  upon completion of all acts necessary for a bill to become
 3  law as provided by Article 4, Section 8 of the Wyoming
 4  Constitution.

 5 

 6         (b)  Except as provided in subsection (a) of this
 7  section, this act is effective July 1, 2001.
