Preschool special education program grants.

A BILL

 

for

 

 1  AN ACT relating to preschool education for children with
 2  disabilities; modifying the distribution of federal funds
 3  available to the state for preschool special education
 4  programs as specified; and providing for an effective date.

 5 

 6  Be It Enacted by the Legislature of the State of Wyoming:

 7 

 8         Section 1.  W.S. 21-2-705 by creating a new subsection
 9  (b) is amended to read:

11         21-2-705.  Fund allocation.

12 

13         (b)  All funds received by the state from the federal
14  government for services to preschool children with
15  disabilities shall be used as follows:

 1              (i)  Not more than five percent (5%) may be
 2  retained by the state department of education for
 3  administration costs;

 4 

 5              (ii)  Not more than twenty percent (20%) shall be
 6  retained by the state department of education for support
 7  services and improvement programs authorized by federal
 8  law.  The amount retained under this paragraph shall be
 9  distributed by the department to the division to be
10  utilized as determined by the division for state level
11  activities authorized by section 619(e)(1) and (f) of the
12  federal Individuals with Disabilities Education Act.  The
13  department shall enter into an agreement with the division
14  for purposes of implementing this paragraph;

15 

16              (iii)  Of the amount remaining following
17  distribution under paragraphs (i) and (ii) of this
18  subsection, an amount equal to seventy-five percent (75%)
19  of the amount received by the state under section 619 of
20  the federal Individuals with Disabilities Education Act
21  during the period beginning October 1, 1996 and ending
22  September 30, 1997, shall be distributed to school
23  districts for services to five (5) year old children with
24  disabilities enrolled in kindergarten and to the division

 1  for services to preschool children with disabilities pro
 2  rata on the basis of the number of preschool children with
 3  disabilities served by school districts and the number of
 4  preschool children with disabilities served by the division
 5  as of December 1, 1996;

 6 

 7              (iv)  Of the amounts remaining following
 8  distribution under paragraphs (i) through (iii) of this
 9  subsection:

11                   (A)  Eighty-five percent (85%) shall be
12  distributed to school districts and to the division in
13  accordance with 20 U.S.C. 1419(g)(1)(B)(i);

14 

15                   (B)  Fifteen percent (15%) shall be
16  distributed to school districts and to the division based
17  upon the proportionate number of children living in
18  poverty, as determined by rule and regulation of the state
19  superintendent.

21         Section 2.  W.S. 21-2-705(a) is repealed.

 1         Section 3.  This act is effective immediately upon
 2  completion of all acts necessary for a bill to become law
 3  as provided by Article 4, Section 8 of the Wyoming
 4  Constitution.
