Civil liability for criminal use of property.

A BILL

 

for

 

 1  AN ACT relating to civil liability for criminal use of
 2  property; limiting liability under certain circumstances;
 3  and providing for an effective date.

 4 

 5  Be It Enacted by the Legislature of the State of Wyoming:

 6 

 7         Section 1.  W.S. 1-1-129 is created to read:

 8 

 9         1-1-129.  Civil liability for criminal use of
10  property.

11 

12         (a)  The owner or possessor of personal property that
13  is stolen is not liable in the absence of gross negligence
14  for injury or damage arising out of the use of the property
15  while the property is possessed by another. The owner of
16  real property that is criminally misused by another without

 1  the owner's knowledge is not liable in the absence of gross
 2  negligence for injury or damage arising out of the misuse.
 3  This section includes property taken by theft, robbery or
 4  burglary directly from the person's body or from a place of
 5  residence, tent or other recreational structure, or motor
 6  vehicle or boat that is owned, possessed or used by the
 7  person owning or possessing the property.

 8 

 9        (b)  This section does not modify, amend or eliminate
10  the doctrines of negligence per se or attractive nuisance.

11 

12        Section 2.  This act is effective July 1, 2001.
