Amendment to licensure and certification of counselors.

A BILL

 

for

 

 1  AN ACT relating to licensure and certification of
 2  professional counselors; allowing a person establishing
 3  domicile in this state who is on active military duty and
 4  employed in an appropriate field within two (2) years prior
 5  to December 31, 1997 to receive licensure; and providing
 6  for an effective date.

 7 

 8  Be It Enacted by the Legislature of the State of Wyoming:

 9 

10         Section 1.  W.S. 33-38-102(a) by creating a new
11  paragraph (xv) and 33-38-106(e)(iv), (f)(ii), (g)(ii),
12  (h)(ii), (j)(i), (k)(iv) and (m)(i) are amended to read:

14         33-38-102.  Definitions.

15 

16         (a)  As used in this act:

 1              (xv)  "Domicile" means that place where a person
 2  has his true, fixed and permanent home to which whenever
 3  the person is absent the person has the intention of
 4  returning.

 5 

 6         33-38-106.  Requirements for licensure and
 7  certification.

 8 

 9         (e)  The board shall issue a license without
10  examination as a licensed professional counselor, licensed
11  clinical social worker, licensed marriage and family
12  therapist or a licensed addictions therapist to any
13  applicant who files an application upon a form and in the
14  manner prescribed by the board, accompanied by the
15  appropriate fee and who furnishes satisfactory evidence to
16  the board of the following:

18              (iv)  The applicant was primarily employed in
19  this state in an area of practice defined by W.S.
20  33-38-102(a)(iv) through (vii) within two (2) years prior
21  to December 31, 1997 or the applicant, while on active
22  military duty, was domiciled in this state and was
23  primarily employed in an area of practice defined by W.S.

 1  33-38-103(a)(iv) through (vii) within two (2) years prior
 2  to December 31, 1997;

 3 

 4         (f)  The board shall issue a license without
 5  examination as a licensed addictions therapist to any
 6  applicant who meets the requirements of paragraphs (e)(i),
 7  (ii), (iv) and (v) of this section and who files an
 8  application upon a form and in the manner prescribed by the
 9  board, accompanied by the appropriate fee and who furnishes
10  satisfactory evidence to the board of the following:

12              (ii)  The applicant was primarily employed in
13  this state in an area of practice defined by W.S.
14  33-38-102(a)(iv) through (vii) within two (2) years prior
15  to December 31, 1997 or the applicant, while on active
16  military duty, was domiciled in this state and was
17  primarily employed in an area of practice defined by W.S.
18  33-38-103(a)(iv) through (vii) within two (2) years prior
19  to December 31, 1997.

21         (g)  The board shall issue a license without
22  examination as a licensed professional counselor, to any
23  applicant who meets the requirements of paragraphs (e)(i),
24  (ii), (iv) and (v) of this section and who files an

 1  application upon a form and in the manner prescribed by the
 2  board, accompanied by the appropriate fee and who furnishes
 3  satisfactory evidence to the board of the following:

 5              (ii)  The applicant was primarily employed in
 6  this state in an area of practice defined by W.S.
 7  33-38-102(a)(iv) through (vii) within two (2) years prior
 8  to December 31, 1997 or the applicant, while on active
 9  military duty, was domiciled in this state and was
10  primarily employed in an area of practice defined by W.S.
11  33-38-103(a)(iv) through (vii) within two (2) years prior
12  to December 31, 1997.

14         (h)  The board shall issue a license with examination
15  as a licensed professional counselor, to any applicant who
16  meets the requirements of paragraphs (e)(i), (ii), (iv) and
17  (v) of this section and who files an application upon a
18  form and in the manner prescribed by the board, accompanied
19  by the appropriate fee and who furnishes satisfactory
20  evidence to the board of the following:

22              (ii)  The applicant was primarily employed in
23  this state in an area of practice defined by W.S.
24  33-38-102(a)(iv) through (vii) within two (2) years prior

 1  to December 31, 1997 or the applicant, while on active
 2  military duty, was domiciled in this state and was
 3  primarily employed in an area of practice defined by W.S.
 4  33-38-103(a)(iv) through (vii) within two (2) years prior
 5  to December 31, 1997.

 7         (j)  The board shall grant certification without
 8  examination as a certified social worker to any applicant 
 9  who files an application upon a form and in the manner
10  prescribed by the board, accompanied by the appropriate fee
11  and who furnishes satisfactory evidence to the board of the
12  following:

13 

14              (i)  The applicant was primarily employed in this
15  state in an area of practice defined by W.S.
16  33-38-102(a)(iv) through (vii) within two (2) years prior
17  to December 31, 1997 or the applicant, while on active
18  military duty, was domiciled in this state and was
19  primarily employed in an area of practice defined by W.S.
20  33-38-103(a)(iv) through (vii) within two (2) years prior
21  to December 31, 1997;

23         (k)  The board shall grant certification without
24  examination as a certified addictions practitioner to any

 1  applicant who files an application upon a form and in the
 2  manner prescribed by the board, accompanied by the
 3  appropriate fee and who furnishes satisfactory evidence to
 4  the board of the following:

 5 

 6              (iv)  The applicant was primarily employed in
 7  this state in the practice of addictions therapy defined by
 8  W.S. 33-38-102(a)(iv) through (vii) within two (2) years
 9  prior to December 31, 1997 or the applicant, while on
10  active military duty, was domiciled in this state and was
11  primarily employed in the practice of addictions therapy
12  defined by W.S. 33-38-102(a)(iv) through (vii) within two
13  (2) years prior to December 31, 1997;

15         (m)  The board shall issue certification without
16  examination as a certified mental health worker to any
17  applicant who files an application upon a form and in the
18  manner prescribed by the board, accompanied by the
19  appropriate fee and who furnishes satisfactory evidence to
20  the board of the following:

21 

22              (i)  The applicant was primarily employed in this
23  state in an area of practice defined by W.S.
24  33-38-102(a)(iv) through (vii) within two (2) years prior

 1  to December 31, 1997, and has five (5) years experience
 2  practicing in that area or the applicant, while on active
 3  military duty, was domiciled in this state and was
 4  primarily employed in an area of practice defined by W.S.
 5  33-38-103(a)(iv) through (vii) within two (2) years prior
 6  to December 31, 1997;

 7 

 8         Section 2.  This act is effective immediately upon
 9  completion of all acts necessary for a bill to become law
10  as provided by Article 4, Section 8 of the Wyoming
11  Constitution.
