Posting of restrictions on roads & lands.

A BILL
for
1 AN ACT relating to
public roads; prohibiting the improper
2
posting of restrictions on public roads and lands as
3
specified; providing definitions; providing penalties; and
4
providing for an effective date.

6 Be It Enacted by the Legislature of the State of Wyoming:
7
8 Section 1. W.S. 24-1-133 is created to read:
9
10 24-1-133. Posting notice of
restrictions on public
11 roads; restrictions; penalties.
12
13 (a) No lessee
or his agent shall post a notice on a
14 public road or land purporting to restrict
access on that
15 road or land unless the restriction has been
approved by

1 the
governing body having jurisdiction over the road or
2
land.

4 (b) For purposes of this section:
5
6 (i) "Public
land" means any land which the
7
public is authorized to use without obtaining legal
8
permission from a private landowner;
9
10 (ii) "Public
road" means any passageway which
11 has been graded or constructed to carry
vehicular traffic
12 or on which repeated vehicular traffic has
created well-
13 defined tracks or other existing legal
rights-of-way which
14 the public is authorized to use without
obtaining legal
15 permission from a private landowner.

17 (c) Any lessee
or agent of the lessee who improperly
18 posts a notice in violation of subsection
(a) of this
19 section shall be issued a citation in person
or by
20 certified mail return receipt requested, for
a first
21 violation requiring removal of the notice.
If the notice is
22 not removed as required within three (3)
days after the
23 citation is issued, the person cited is
guilty of a
24 misdemeanor and upon conviction is subject
to a fine of not

more than six hundred dollars ($600.00), up to six (6)
2 months
in jail, or both. If the person does not remove the
3
notice as required within three (3) days, each subsequent
4 day
shall constitute a separate violation of subsection (a)
5 of
this section. The penalty under this subsection shall
6 increase
for each subsequent violation by multiplying the
7
penalty imposed under this subsection by the number of
8
violations.

10 Section 2. This act is effective July 1, 2001.
