State budgeting process.

A BILL
for
1 AN ACT relating to the
state budget process; establishing a
2
base budget comparison and reporting process for state
3 agencies;
defining terms; modifying the standard budget
4
process accordingly; imposing reporting requirements and
5
other duties upon the state budget division; and providing
6 for
an effective date.

8 Be It Enacted by the Legislature of the State of Wyoming:
9
10 Section 1. W.S. 9-2-1002(a)(ix)
and by creating a new
11 paragraph (xii), 9-2-1011(a) and by
creating a new
12 subsection (c) and 9-2-1012 by
creating a new subsection
13 (f) are amended to read:
14
15 9-2-1002. Definitions; powers
generally; duties of
16 governor; provisions construed; cooperation with
17 legislature and judiciary; divisions enumerated.

2 (a) As used in this act:
3
4 (ix) "Standard
budget" means a budget enabling
5 an
entity to continue to furnish the same level of services
6
during the ensuing biennium and shall reflect the revenue
7 or
appropriation necessary to provide the services. The
8
budget shall include all personnel approved in the
9
preceding biennial budget, a supportive service category
10 and the amount of revenue generated by the
entity during
11 the preceding biennium and estimated revenue
for the
12 ensuing biennium regardless of the fund to
which the monies
13 were deposited. For
state agencies and the University of 14
Wyoming, the
standard budget shall also include the 15
replacement of
equipment. The standard budget shall not
16 include any personnel other than those
specifically
17 authorized in the preceding biennial budget. The standard
18 budget shall not
include requests for any equipment, any
19 special projects
and services nor any requests for special
20 or nonrecurring
funding;
21
22 (xii) "Base budget" means a budget containing
23 all
legislative appropriations as defined by W.S.
24 9-2-1013(d)(iv),
which shall be prepared by the division

1 for each entity containing all programs for the biennium
2 preceding the biennium for which a
standard budget is being
3 prepared pursuant to this act. The base budget and all
4 information accompanying the base
budget as required by
5 this act shall be of sufficient detail
to parallel
6 components of the standard budget
prepared for each entity
7 under this act.

9 9-2-1011. Duties of budget division; preparation of
10 standard budget estimates; entities to prepare expanded and
11 exception budgets; form; required information; base
12 budgets.

14 (a) Subject to subsection (c) of this section, the
15 department through the budget division shall
prepare
16 standard budget estimates. Entities shall
prepare expanded
17 and exception budgets in a form consistent
with the
18 standard budgets as directed by the
department.
19
20 (c) The budget division shall for purposes of
21 preparing
the standard budget for entities under this
22 section,
include the base budget and the specific amount
23 the
base budget differs from the standard budget estimate.
24 The
differences shall be itemized and explained in writing

1 on a standardized form prescribed by rule and regulation of
2 the division. The base budget and accompanying forms shall
3 be included within the budget
estimates and related
4 information for each entity as
compiled under W.S.
5 9-2-1012(b).

7 9-2-1012. Duties of budget division;
transmittal of
8 standard budget and
manual; return of completed exception
9 and expanded budgets;
submission to governor; disposition
10 of excess general fund appropriations; submission of
11 selected budget information to joint appropriations interim
12 committee.

14 (f) In addition to subsection (b) of this section and
15 not
later than October 1 of each odd-numbered year, the
16 administrator
of the budget division shall file with the
17 legislative
service office a copy of the base budget,
18 standard
budget estimate and accompanying base budget forms
19 required
under W.S. 9-2-1011(c) for each entity.
The
20 legislative
service office shall provide copies of the
21 information
filed under this subsection to the joint
22 appropriations
interim committee.
