Recreating on state lands.

A BILL

 

for

 

 1  AN ACT relating to state lands; authorizing camping,
 2  hunting, fishing and other recreational activity on state
 3  lands in accordance with rules of the board of land
 4  commissioners as specified; making conforming and
 5  clarifying amendments; and providing for an effective date.

 6 

 7  Be It Enacted by the Legislature of the State of Wyoming:

 8 

 9         Section 1.  W.S. 36-2-107 and 36-9-116 are amended to
10  read:

11 

12         36-2-107.  Rules and regulations.

13 

14         (a)  The board shall have the power and authority to
15  promulgate and adopt rules and regulations not inconsistent
16  with the laws of the state, as it may from time to time

 1  deem necessary in the direction, control, disposition and
 2  care of all state lands.

 3 

 4         (b)  The rules of the board adopted pursuant to
 5  subsection (a) of this section shall authorize persons to
 6  camp, hunt, fish and engage in other recreational activity
 7  on state lands to the extent the activity does not prevent
 8  the effective use of the land by a lessee or otherwise
 9  measurably decrease the value of the state land. Any
10  camping, hunting, fishing or other recreational activity on
11  state land shall be in accordance with rules of the board.
12  The rules shall specify requirements for open camp fires,
13  taking into account public welfare and safety and
14  preservation of state lands.

16         36-9-116.  Trespass.

17 

18  Except as authorized by law or by rule and regulation of
19  the board, any person who shall use or who shall occupy any
20  state land without lease or certificate of purchase, and
21  any person who shall use or occupy state lands for more
22  than thirty (30) days after the cancellation or expiration
23  of his lease, unless he shall be a purchaser thereof, shall
24  be a trespasser; and upon conviction thereof shall be fined

 1  not less than twenty-five dollars ($25.00) and not more
 2  than five hundred dollars ($500.00), and the bondsmen of
 3  such lessee shall, upon the bond of such lessee, be equally
 4  liable with the lessee for the payment of such fine
 5  imposed.

 7         Section 2.  This act is effective July 1, 2001.
