Data connectivity grant program.

A BILL

 

for

 

 1  AN ACT relating to cities, towns and counties; providing
 2  for data connectivity grants as specified; establishing a
 3  special contingency account within the capital construction
 4  account for this purpose; crediting a portion of funds
 5  exceeding threshold amounts within the severance tax
 6  distribution account to the contingency account for a
 7  limited period of time; imposing duties upon the state loan
 8  and investment board and the department of administration
 9  and information; and providing for an effective date.

11  Be It Enacted by the Legislature of the State of Wyoming:

12 

13         Section 1.  W.S. 9-4-604 by creating a new subsection
14  (p) and 39-14-801(b) are amended to read:

 1         9-4-604.  Distribution and use; capital construction
 2  projects and bonds; municipal, county and special district
 3  purposes.

 4 

 5         (p)  Revenues credited to the capital construction
 6  account under W.S. 39-14-801(c) shall be deposited into a
 7  special contingency account to be expended in accordance
 8  with this subsection.  No funds shall be expended from the
 9  special contingency account until the funds have been
10  appropriated by the legislature to the state loan and
11  investment board through the normal budget process to be
12  used in the board's discretion for the purposes authorized
13  by this subsection. Funds deposited into the special
14  contingency account shall be used to award grants to
15  incorporated cities, towns and counties for the development
16  of necessary infrastructure for the support of data
17  connectivity. Any city, town or county may apply for a data
18  connectivity grant in a form and manner required by rule
19  and regulation of the board. No grant shall be made by the
20  board under this subsection until the grant application has
21  been referred by the board to the department of
22  administration and information for review as determined by
23  the board. The department shall provide the board with a
24  written report and analysis of the referred grant

 1  application and any other technical assistance requested by
 2  the board. The board shall, to the extent funds are
 3  available in the account, award grants from the special
 4  contingency account as authorized by this subsection only
 5  if the board finds the grant complies with the following:

 6 

 7              (i)  The data connectivity infrastructure project
 8  is technically and economically feasible as determined by
 9  the department of administration and information;

11              (ii)  The data connectivity use plan enhances the
12  provision of public services and the local economy;

13 

14              (iii)  The grant will finance not more than
15  seventy-five percent (75%) of the total project cost.

16 

17         39-14-801.  Severance tax distributions; distribution
18  account created; formula.

19 

20         (b)  To the extent that deposits into the account
21  created under subsection (a) of this section exceed one
22  hundred fifty million dollars ($150,000,000.00) in any
23  fiscal year, the excess shall be credited as follows:

 1              (i)  For the period beginning July 1, 2001, and
 2  ending June 30, 2005, twenty-five percent (25%) of the
 3  excess amount not to exceed five million dollars
 4  ($5,000,000.00) during any one (1) fiscal year, to the
 5  capital construction account created under W.S. 9-4-604(a);

 6 

 7              (ii)  Not less than seventy-five percent (75%) of
 8  the excess amount following distribution under paragraph
 9  (b)(i) of this section, to the general fund. Beginning July
10  1, 2005, one hundred percent (100%) to the general fund.

12         Section 2.  This act is effective July 1, 2001.
