Medical records release of information.

A BILL

 

for

 

 1  AN ACT relating to medical records; authorizing the release
 2  of medical records to the Wyoming board of medicine as
 3  specified; and providing for an effective date.

 4 

 5  Be It Enacted by the Legislature of the State of Wyoming:

 6 

 7         Section 1.  W.S. 35-2-609(b)(ii) and 35-2-610(a)(viii)
 8  are amended to read:

 9 

10         35-2-609.  Disclosure without patient's authorization.

11 

12         (b)  A hospital may disclose health care information
13  about a patient without the patient's authorization if the
14  disclosure is:

15 

16              (ii)  To federal, state or local public health
17  authorities or to the Wyoming board of medicine, to the

 1  extent the hospital is required by law to report health
 2  care information or when needed to protect the public
 3  health;

 4 

 5         35-2-610.  Compulsory process.

 6 

 7         (a)  Health care information shall not be disclosed by
 8  a hospital pursuant to compulsory legal process or
 9  discovery in any judicial, legislative or administrative
10  proceeding unless:

11 

12              (viii)  The health care information is relevant
13  to a proceeding brought under W.S. 35-2-616 or 33-26-401;
14  or

15 

16         Section 2.  This act is effective July 1, 2001.
