State employees-COLA.

A BILL
for
1 AN ACT relating to the
administration of government;
2
authorizing a cost-of-living adjustment for state employees
3 and
employees of the University of Wyoming and community
4
colleges as specified; and providing for an effective date.
5
6 Be It Enacted by the Legislature of the State of Wyoming:
7
8 Section 1. W.S. 9-3-106 is created to read:
9
10 9-3-106. Cost-of-living adjustment.
11
12 Notwithstanding any compensation action
taken by the state
13 employee compensation commission created
under W.S.
14 9-2-1019 or any state agency or department
under the
15 authority of any agency or department pay
plan, all state
16 employees, including employees of the
University of Wyoming
17 and all community colleges, shall receive an
annual salary

adjustment corresponding to the percentage change in the
2
Wyoming cost-of-living index. The percent change shall be
3
calculated by the economic analysis division and measured
4
from the first quarter to the fourth quarter of every
5
calendar year. The funds necessary to provide the salary
6
adjustment under this section shall be computed by the
7
department of administration and information and these
8
amounts shall be included in each agency’s standard budget
9
request each biennium beginning with the budget request for
10 the 2003-2004 biennium. In no event shall
the cost-of-
11 living adjustment under this section exceed
five percent
12 (5%) annually. Any employee whose
performance is considered
13 below acceptable standards under a qualified
performance
14 appraisal system shall not be eligible for
any cost-of-
15 living increase under this section until
such time as his
16 performance is appraised as meeting
acceptable standards.
17 The human resources division of the
department of
18 administration and information, the human
resource office
19 of the University of Wyoming and each
community college
20 district board shall promulgate appropriate
rules and
21 regulations necessary to administer the
program authorized
22 by this section.
