Plan A firemen's pension fund-amendments.

A BILL

 

for

 

 1  AN ACT relating to the firemen's pension fund; increasing
 2  base benefits and benefits payable to surviving spouse and
 3  dependent parents as specified; eliminating a separate
 4  surviving spouse amount for dependent children; specifying
 5  applicability; and providing for an effective date.

 6 

 7  Be It Enacted by the Legislature of the State of Wyoming:

 8 

 9         Section 1.  W.S. 15-5-204(a) and (c)(ii), 15-5-205(a)
10  and (b) and 15-5-206 are amended to read:

11 

12         15-5-204.  Pensions; amounts; qualifications; when
13  paid; disability benefits; disqualifications; examinations;
14  disallowance; actions.

16         (a)  Any person qualifying may retire from active
17  service and receive a monthly pension of fifty-seven and

 1  five-tenths percent (57.5%) seventy-five percent (75%) of
 2  the maximum monthly salary of a fireman first class. Any
 3  benefit increases which may occur shall not subsequently be
 4  withdrawn. This benefit accrues to any paid fireman who has
 5  completed twenty (20) years of active service in regularly
 6  constituted fire departments of any cities, towns, counties
 7  or fire protection districts and to any paid fireman
 8  suffering from a mental or physical disability rendering
 9  him unfit for active duty. Any paid fireman covered under
10  this article may continue service beyond twenty (20) years
11  and receive an additional benefit of one and one-half
12  percent (1.5%) of the maximum salary of a fireman first
13  class for each year of service beyond twenty (20) years.

15         (c)  After ten (10) years as a full time paid fireman,
16  any fireman upon terminating his employment for any reason
17  may have his choice of:

19              (ii)  Upon the twentieth anniversary of the date
20  of his employment as a full time paid fireman he may draw a
21  monthly pension computed as follows:

 6         15-5-205.  Death benefits to surviving spouse;
 7  amounts; limitations; length of payments.

 8 

 9         (a)  If any paid fireman dies from any cause, the
10  board shall pay to the surviving spouse a monthly pension
11  equal to the greater of two-thirds (2/3) of the monthly
12  benefit payable to the fireman under W.S. 15-5-204 or two-
13  thirds (2/3) of the monthly benefit payable under W.S.
14  15-5-204(a) for twenty (20) years of active service.
15  Benefits payable under this subsection shall be paid out of
16  the firemen's pension account and shall continue for the
17  spouse's life. In addition, the board shall pay to the
18  surviving spouse an amount equal to one-tenth (1/10) of the
19  maximum monthly salary of a fireman first class per month
20  for the support and maintenance of each child of the
21  deceased fireman under the age of eighteen (18) years and
22  who was supported by the fireman prior to his death.
23  However, the additional payment for the support of children

 1  shall not exceed three-tenths (3/10) of the maximum monthly
 salary of a fireman first class.

 3 

 4  (b)  If the fireman is a retired fireman drawing his
 5  pension at the time of his death, the board shall pay to
 6  the surviving spouse a monthly pension equal to two-thirds
 7  (2/3) of the monthly benefit payable to the fireman under
 8  W.S. 15-5-204. Benefits payable under this subsection shall
 9  be paid out of the firemen's pension account and shall
10  continue for the spouse's life. In addition, the board
11  shall pay the surviving spouse the sum of twenty dollars
12  ($20.00) per month for the support and maintenance of each
13  child of the deceased, retired fireman under the age of
14  eighteen (18) years who was supported by the retired
15  fireman at the time of his death, but not to exceed the
16  total of sixty dollars ($60.00) per month.

18         15-5-206.  Death benefits to dependent father and
19  mother; amounts.

20 

21  If any paid fireman dies, leaving no surviving spouse or
22  children, but leaves a surviving dependent father or mother
23  or both, the board shall pay to the mother if there is no
24  father, to the father if there is no mother or to both, out

 1  of the firemen's pension account, a monthly amount equal to
 2  two-thirds (2/3) of the pension the retired fireman was
 3  receiving if retired at the time of his death, or if in
 4  active service at the time of death, a monthly amount equal
 5  to the greater of two-thirds (2/3) of the monthly benefit
 6  payable to the fireman under W.S. 15-2-204 at the time of
 7  his death or two-thirds (2/3) of the monthly benefit
 8  payable under W.S. 15-2-204(a) for twenty (20) years of
 9  active service. If either the surviving mother or father
10  dies after the payments have started, the board shall pay
11  to the surviving parent the full amount as computed under
12  this section.

14         Section 2.  W.S. 15-5-205(c) is repealed.

15 

16         Section 3.  The increase to the base benefit and the
17  benefit payable to the surviving spouse and dependent
18  parents provided under section 1 of this act shall apply to
19  all benefits payable under W.S. 15-5-201 through 15-5-209
20  on or after July 1, 2001, and shall not apply to benefit
21  payments made under W.S. 15-5-201 through 15-5-209 prior to
22  July 1, 2001.
