Retirement-warden, patrol, DCI amendments.

A BILL

 

for

 

 1  AN ACT relating to the Wyoming State Highway Patrol, Game
 2  and Fish and Criminal Investigator Retirement Act; revising
 3  salary definitions as used in benefit computations;
 4  increasing benefit formula components and the cost-of-
 5  living adjustment; and providing for an effective date.

 6 

 7  Be It Enacted by the Legislature of the State of Wyoming:

 8 

 9         Section 1.  W.S. 9-3-602(a) by creating a new
10  paragraph (xiv) and by renumbering paragraph (xiv) as (xv),
11  9-3-610(a), (d)(intro), (ii), (iii) and (vi) and
12  9-3-611(d)(i) through (iii) are amended to read:

14         9-3-602.  Definitions.

16         (a)  As used in this article:

 1  (xiv)  "Highest average salary" means the
 2  employee's average annual salary for the highest paid three
 3  (3) continuous years of service;

 4 

 5              (xiv)(xv)  "This act" means W.S. 9-3-602 through
 6  9-3-620.

 7 

 8         9-3-610.  Amount of benefit.

 9 

10         (a)  The service retirement allowance payable to an
11  employee under this article at age fifty (50), shall be
12  equal to two and twenty-five one hundredths percent (2.25%)
13  two and one-half percent (2.5%) of the employee's final
14  highest average salary for each year of credited service in
15  the program, provided the retirement allowance does not
16  exceed seventy-five percent (75%) of the final highest
17  average salary.

19         (d)  Effective July 1, 1999 2001 and on each July 1
20  thereafter, any service retirement allowance, survivor
21  benefit or disability benefit received by eligible
22  individuals under this act shall be adjusted as follows:

 1              (ii)  The benefits existing on each July 1 for
 2  each eligible individual shall be increased by the lesser
 3  of the percentage increase in the cost of living as
 4  determined by the board or by one and one-half percent
 5  (1 1/2%) two and one-fourth percent (2¼%);

 6 

 7              (iii)  The amount of any percentage increase in
 8  the cost of living which exceeds one and one-half percent
 9  (1 1/2%) two and one-fourth percent (2¼%) shall be
10  accumulated and added to the percentage increases in the
11  cost of living for future years;

12 

13              (vi)  The total benefit adjustment under this
14  subsection shall not exceed one and one-half percent
15  (1 1/2%) two and one-fourth percent (2¼%) in any one (1)
16  year.

18         9-3-611.  Eligibility and amount of disability
19  allowance.

20 

21         (d)  Disability allowances shall be as follows:

22 

23              (i)  Fifty percent (50%) of final highest average
24  salary for duty-connected or ordinary total disability;

 2              (ii)  Thirty-five percent (35%) of final highest
 3  average salary for duty-connected partial disability; and

 4 

 5              (iii)  Twenty-five percent (25%) of final highest
 6  average salary for ordinary partial disability.

 7 

 8         Section 2.  W.S. 9-3-602(a)(vii) is repealed.

 9 

10         Section 3.  This act is effective July 1, 2001.
