Omnibus water bill-planning.

A BILL
for
1 AN ACT relating to water
development projects; authorizing
2
specified Level I and Level II studies and providing
3 appropriations;
requiring reports; providing for reversion
4 of
unexpended funds; authorizing unobligated funds to be
5
used to complete other designated project studies under
6
certain conditions; delaying the reversion of certain
7
monies appropriated for expenses related to the endangered
8
species act; providing funding for a position to assist in
9
water conservation efforts; and providing for an effective
10 date.

12 Be It Enacted by the Legislature of the State of Wyoming:

1. 2000 Wyoming

15 Sections 2 through 5 is amended to read:

2 Section 2. LEVEL I RECONNAISSANCE STUDIES -
3 NEW DEVELOPMENT.
The following sums of money are
4
appropriated from water development account I to
5 the
commission to be expended to conduct the
6
following reconnaissance studies as defined in
7
W.S. 41-2-114. Funds appropriated under this
8
section for a particular project which are in
9
excess of the actual amount necessary to complete
10 the study may, subject to the review of the
11 select water committee, be expended by the
12 commission to complete the reconnaissance
study
13 for any other project listed in this section.
14 Appropriated funds not expended prior to
July 1,
15 2002, shall revert to water development
account
16 I. The commission shall submit a report to
the
17 legislature on each of the following studies
18 prior to the 2002 legislative session.

administration of any
47 facilities and associated water
rights shall be identified,
48 addressed and resolved prior to any
further funding
49 authorization.

Wyoming Session Laws, Chapter 81,
14 Section 5 is amended to read:

16 Section 5. There is
appropriated from water
17 development account I to the
state engineer's
18 office one million seven hundred
thousand dollars
19 ($1,700,000.00) for the state's
proportionate
20 share of the capitalization of
components to
21 recover and remove, from the
endangered species
22 act list, four (4) species of fish
that inhabit
23 the Upper Colorado River basin. The
state's
24 proportionate share shall be two and
one-half
25 percent (2.5%) of the total cost of
the capital
26 construction program for the
recovery of the
27 species or one million seven hundred
thousand
28 dollars ($1,700,000.00), whichever is
less. Funds
29 appropriated shall not be expended
until funding
30 for the participating states and the
federal
31 government has been appropriated and
made
32 available to meet construction costs
believed to
33 be necessary for the recovery of the
species.
34 Funds appropriated in this section
that are not
35 expended prior to July 1, 2001 2005,
shall revert
36 to water development account I.

38 Section
3. Contingent upon the availability of
39 United States Bureau of Reclamation
matching funds,
40 there is appropriated fifty thousand
dollars
41 ($50,000.00) from water development
account I to the

1 state engineer's office
to meet the state's
2
proportionate share of the contract expense for the
3
conservation staff position for fiscal year 2002.
4
Contingent upon the availability of United States
5
Bureau of Reclamation matching funds, the balance of
6
state funds remaining as of July 1, 2002 may be
7
applied to the state's proportionate share for the
8
conservation staff position for fiscal year 2003. Any
9
unspent funds shall revert to water development
10 account I on July 1, 2003.
11
12 Section 4. This act is effective immediately upon
13 completion of all acts necessary for a bill
to become law
14 as provided by Article 4, Section 8 of the
Wyoming
15 Constitution.
