Prisoners-payment of medical expenses.

A BILL
for
1 AN ACT relating to
prisoners; modifying county and state
2
responsibilities for payment of medical expenses of
3 prisoners
sentenced to the custody of the department of
4
corrections; specifying applicability of the act; and
5
providing for an effective date.

7 Be It Enacted by the Legislature of the State of Wyoming:
8
9 Section
1. W.S. 7-13-103(b) and (c) is amended to
10 read:
11
12 7-13-103. Notice of sentence;
transportation to
13 institution; maintenance of prisoner in county jail.
14
15 (b) Except
as provided in subsection (c) of this
16 section, the director of the department of
corrections
17 shall arrange for the transportation of the
person to a

state penal institution, at state expense, within ten (10)
2
days after the judgment and sentence is signed by the
3
judge. Except as provided in subsection
(c) of this
4 section, prior to being
transported to the institution, the
5
prisoner shall be maintained in the county jail at the
6
expense of the county.

8 (c) Upon agreement of the sheriff and
the director of
9 the
department of corrections, the prisoner may be
10 maintained at the county jail at an agreed
per diem rate to
11 be paid by the department for an additional
period of not
12 more than thirty (30) days after expiration
of the ten (10)
13 days provided by subsection (b) of this section.
The
14 department shall pay for any medical
treatment of the
15 prisoner, other than for conditions
demanding immediate
16 medical attention which can be treated at
the county jail
17 and other than
medical treatment for which the county is
18 liable
under W.S. 18-6-303(c)(i), which is
provided after
19 the expiration
of the ten (10) days provided by subsection 20
(b) of this
section judgment and sentence is signed
by the
21 judge. Except for emergency medical treatment, no treatment
22 which is the responsibility of the
department under this
23 subsection shall be provided without the
prior approval of
24 the department.

2 Section 2. This act shall not apply to any medical
3 treatment
provided to any prisoner prior to the effective
4
date of this act.

6 Section 3. This act is effective July 1, 2001.
