A BILL
for
1 AN ACT relating to
government reorganization; creating a
2 department
of workforce services; specifying department
3
components; requiring reports as specified; providing for
4
subsequent reorganization of the department; repealing a
5
restriction on the creation of new departments; and
6
providing for an effective date.

8 Be It Enacted by the Legislature of the State of Wyoming:
9
10 Section 1. W.S. 9-2-2018 is created to read:
11
12 9-2-2018. Department of workforce
services created;
13 director appointed; structure.
14
15 (a) As part of
the reorganization of Wyoming state
16 government, there is created the Wyoming
department of

workforce services. The provisions of the Wyoming
2
Government Reorganization Act of 1989, W.S. 9-2-1701
3
through 9-2-1708 apply to this section, except the
4
requirement under W.S. 9-2-1707(a)(iii) that public
5
hearings regarding the reorganization plan required under
6
subsection (b) of this section be conducted by at least two
7 (2)
interim committees of the legislature shall not apply.
8
9 (b) The
administrative head of the department shall
10 be a director appointed by the governor not
later than
11 April 1, 2001. The director shall prepare a plan for
12 reorganization of the agencies, programs and
functions
13 specified in this section and submit it to
the governor for
14 approval.
The department reorganization plan, as approved,
15 shall be submitted to the joint labor,
health and social
16 services interim committee of the
legislature no later than
17 August 15, 2001 and made available to the
public. The
18 committee shall hold at least one (1) public
hearing
19 regarding the plan before the 2002 budget
session of the
20 legislature convenes. The joint labor, health and social
21 services interim committee shall report to
the legislature
22 by December 1, 2001, its recommendations on
the plan,
23 including necessary legislation with respect
to the plan.

plan, as approved by act of the legislature, shall be
2 implemented
not later than July 1, 2002.

4 (c) The
department reorganization plan shall consider
5
whether the following functions or programs are assigned
6
from or to the agency or department specified under a
7
Type 2 transfer:
8 PROGRAM; FROM; TO
9
10 (i) Displaced
worker education and training;
11 Employment; Workforce services
12
13 (ii) Division of
vocational rehabilitation;
14 Employment; Workforce services
15
16 (iii) Public
employment offices; Employment;
17 Workforce services
18
19 (iv) Veterans'
employment services; Employment;
20 Workforce services

22 (v) Unemployment
insurance program; Employment;
23 Workforce services

1 (vi) Adult
education and literacy; Community
2
college commission; Workforce services
3
4 (vii) Senior
community service employment
5
program; Health; Workforce services
6
7 (viii) Wyoming
school-to-careers program;
8
Employment; Workforce services
9
10 (ix) Personal
opportunities with employment
11 responsibilities (POWER) program; Family
services;
12 Workforce services
13
14 (x) Workforce
development training fund;
15 Employment; Workforce services
16
17 (xi) Food stamp
employment program; Family
18 services; Workforce services
19
20 (xii) Other
programs that may be identified that
21 may improve customer satisfaction or reduce
program
22 delivery costs.

24 (d) As used in this section:

2 (i) "Community
college commission" means the
3 community
college commission of Wyoming;
4
5 (ii) "Education"
means the department of
6
education;
7
8 (iii) "Employment"
means the department of
9
employment;
10
11 (iv) "Family
services" means the department of
12 family services;
13
14 (v) "Governor" means the office of the governor;
15
16 (vi) "Health" means the department of health;
17
18 (vii) "Workforce
services" means the department
19 of workforce services created by this
section.

21 (e) In
developing the plan required under W.S.
22 9-2-1707(a)(iii), the director shall
consider:

1 (i) The
cost-effectiveness of any recommended
2
transfer;
3
4 (ii) Whether the
recommended transfer will
5
result in a more efficient provision of service to
6
customers;
7
8 (iii) The extent
to which the recommended
9
transfer would benefit from involvement by the Wyoming
10 business council;
11
12 (iv) Developing
a system that will adequately
13 serve customers in both urban and rural
areas;
14
15 (v) Recommending
legislation necessary to allow
16 data sharing for the purpose of evaluating
programs and the
17 sharing of a common intake and management
information
18 system;
19
20 (vi) Identifying
outcome-based data for all
21 workforce programs, including those programs
not proposed
22 for transfer to the department of workforce
services under
23 this section. Upon approval of the plan by
the legislature,
24 the director shall submit a report to the
governor and the

joint labor, health and social services interim committee
2 no
later than October 1 of each year thereafter addressing
3 the
results of such program evaluations;
4
5 (vii) Developing
memoranda of understanding for
6
confidentiality of information and data sharing.

8 (g) To the
extent not prohibited by federal law, any
9
agency or program of the state may provide information to
10 the director as necessary to develop the
plan required
11 under W.S. 9-2-1707(a)(iii).

13 Section 2. W.S. 9-2-1704(a)(intro) is amended to
14 read:
15
16 9-2-1704. Reorganization plan; structure; time frame.
17
18 (a) Pursuant to
this act and other laws establishing
19 individual departments, the entire executive
branch of
20 state government shall be organized into not
more than
21 fourteen (14) fifteen (15) principal departments except for
22 the offices of the following officials and
except as
23 provided in subsections (d), (e) and (f) of
this section:

1 Section 3. W.S. 9-2-1704(b) is repealed.

3 Section 4. This act is effective immediately upon
4
completion of all acts necessary for a bill to become law
5 as
provided by Article 4, Section 8 of the Wyoming
6
Constitution.
