Removing bodies from graves.

A BILL
for
1 AN ACT relating to
crimes and offenses; modifying

provisions relating to permission to open a tomb or grave;
3 and
providing for an effective date.

5 Be It Enacted by the Legislature of the State of Wyoming:

7 Section 1. W.S. 6-4-501(a) is amended to read:
8
9 6-4-501. Opening graves and removing
bodies; penalty;
10 exception.

12 (a) A person
who opens a grave or tomb and removes a
13 body or remains of a deceased person for any
purpose
14 without the knowledge and consent of near relations the
15 nearest living
kinof the deceased commits a
misdemeanor
16 punishable by a fine of not more than seven
hundred fifty
17 dollars ($750.00). For purposes of this section, the

1 "nearest living kin" shall be determined by
applying the
2 order specified in W.S. 2-4-201(a)(i)
through (vii). If
3 two (2) or more persons are in the
same category, the
4 oldest shall be the nearest living
kin.

6 Section 2. This act is effective July 1, 2001.
