Municipal traffic violation penalties-school fund.

A BILL
for
1 AN ACT relating to
traffic violations penalties; requiring
2 that
fines and penalties imposed for violation of traffic
3
ordinances of a city or town shall be paid into the county
4
school fund; and providing for an effective date.

6 Be It Enacted by the Legislature of the State of Wyoming:
7
8 Section
1. W.S.
5-6-204, 5-6-303 and 5-9-106 are
9
amended to read:
10
11 5-6-204. Fines and penalties to be
paid to city
12 treasurer; report of cases; failure to comply with section.
13
14 All fines and penalties collected and
arising from a breach
15 of a city ordinance, except fines and penalties collected
16 for violations of
traffic ordinances regulating speed

1 limits, shall be deposited with the city
treasurer, and the
2 municipal
judge shall report at the end of each calendar
3
month a list of all cases for violations of city ordinances
4
instituted in his court, and the disposition thereof, with
5 a
statement of the fines, penalties and costs received. All
6 fines and penalties collected and arising from a breach of
7 a city ordinance regulating speed limits shall be paid into
8 the county treasury to the credit of the public school fund
9 of the county. At the end of each month the judge
shall
10 deposit with the city treasurer or the county treasurer, as
11 appropriate,
all fines, penalties and costs received. If
12 the municipal judge fails to report and
deposit all fines,
13 penalties and costs for a period of twenty-five
(25) days,
14 his office shall be declared vacant. If a
city enacts an
15 ordinance prescribing a court automation fee
as provided in
16 W.S. 5-6-108, the fee shall be remitted to
the judicial
17 systems automation account established by
W.S. 5-2-120.

19 5-6-303. Disposition of fines and penalties.
20
21 All fines and penalties collected, arising
from a breach of
22 the ordinances of the town, except fines and penalties
23 collected for
violations of traffic ordinances regulating
24 speed limits,
shall be paid into the town treasury. All

1 fines and penalties collected and arising from a breach of
2 a town ordinance regulating speed
limits shall be paid into
3 the county treasury to the credit of
the public school fund
4 of the county. If a town
enacts an ordinance prescribing a
5 court
automation fee as provided in W.S. 5-6-108, the fee
6 shall
be remitted to the judicial systems automation
7
account established by W.S. 5-2-120.

9 5-9-106. Disposition of money
collected for
10 violations of city or town ordinances; disposition of fines
11 and penalties under general state laws.
12
13 All money collected by a judge of a circuit
court for
14 violations of ordinances of a city or town, except fines
15 and penalties
collected for violations of traffic
16 ordinances
regulating speed limits, shall be paid into the
17 general fund of the city or town whose
ordinance was
18 violated. All
fines and penalties collected and arising
19 from a breach of
a city or town ordinance regulating speed
20 limits shall be
paid into the county treasury to the credit
21 of the public
school fund of the county. The circuit court
22 shall keep separate account books of funds
for ordinance
23 violations as designated by the director of
the state
24 department of audit. All fines and penalties
under the

general laws of the state shall be paid into the county
2
treasury to the credit of the public school fund of the
3
county.

5 Section 2. This act is effective July 1, 2001.
