Prescription drugs in jails.

A BILL
for
1 AN ACT relating to
crimes and offenses; providing that the
2
improper ingestion of prescription medication by a person
3 in
the state's custody is a crime as specified; and
4
providing for an effective date.

6 Be It Enacted by the Legislature of the State of Wyoming:
7
8 Section 1. W.S. 6-5-208 is amended to read:
9
10 6-5-208. Taking controlled substances
or liquor into
11 jails, penal institutions or mental hospitals; penalties.
12
13 (a) Except as
authorized by a person in charge, a
14 person commits a felony punishable by
imprisonment for not
15 more than three (3) years, a fine of not
more than three
16 thousand dollars ($3,000.00), or both, if
that person:

1 (i) Takes or
passes any controlled substance or
2
intoxicating liquor into a jail, a state penal institution,
3 the
Wyoming boys' school, Wyoming girls' school, a
4 correctional
facility operated by a private entity pursuant
5 to
W.S. 7-22-102 or the state hospital;. or
6
7 (ii) Possesses any
prescription medication or
8 ingests a prescription medication in a
manner inconsistent
9 with the instructions printed on the
label of the original
10 container
supplied with the medication, while in the
11 custody
of a jail, a state penal institution, the Wyoming
12 boys'
school, the Wyoming girls' school, a correctional
13 facility
operated by a private entity pursuant to W.S.
14 7-22-102
or the state hospital.

16 Section 2. This act is effective July 1, 2001.
