Speed limits on two-lane roads.

A BILL

 

for

 

 1  AN ACT relating to speed limits; amending the maximum speed
 2  limit on roads other than interstate highways as specified;
 3  conforming violations and penalties as specified; and
 4  providing for an effective date.

 5 

 6  Be It Enacted by the Legislature of the State of Wyoming:

 7 

 8         Section 1.  W.S. 31-5-301(b)(iv) and (d),
 9  31-5-1201(d)(i), (ii) and (g) and 31-18-704 are amended to
10  read:

11 

12         31-5-301.  Maximum speed limits.

13 

14         (b)  Except when a special hazard exists that requires
15  lower speed for compliance with subsection (a) of this
16  section, the limits specified in this subsection or

 1  established as otherwise authorized shall be maximum lawful
 2  speeds and no person shall drive a vehicle on a highway at
 3  a speed in excess of maximum limits:

 4 

 5              (iv)  Sixty-five (65) Seventy (70) miles per hour
 6  in other locations;

 7 

 8         (d)  Speeding violations of up to eighty (80) miles
 9  per hour under W.S. 31-5-301(b)(iii) or up to seventy (70)
10  seventy-five (75) miles per hour under W.S.
11  31-5-301(b)(iv), except violations received while operating
12  a commercial motor vehicle as defined by W.S.
13  31-7-102(a)(viii), shall not be made a part of the
14  abstracts or records kept by the department of
15  transportation pursuant to W.S. 31-5-1214 or 31-7-120.

17         31-5-1201.  Violation of provisions to constitute
18  misdemeanor; penalties.

19 

20         (d)  Except as provided in subsection (g) of this
21  section:

22 

23              (i)  Every person convicted of a violation of
24  W.S. 31-5-301(b)(iii), for speeds of seventy-six (76)

 1  through eighty (80) miles per hour, or W.S.
 2  31-5-301(b)(iv), for speeds of sixty-six (66) seventy-one
 3  (71) through seventy (70) seventy-five (75) miles per hour,
 4  shall be fined five dollars ($5.00) for each mile per hour
 5  in excess of the legal speed limit not to exceed twenty-
 6  five dollars ($25.00);

 7 

 8              (ii)  Every person convicted of a violation of
 9  W.S. 31-5-301(b)(iv), for speeds at or above seventy (70)
10  seventy-five (75) miles per hour, shall be fined twenty-
11  five dollars ($25.00) plus three dollars ($3.00) per mile
12  for each mile per hour in excess of seventy (70) seventy-
13  five (75) miles per hour with assessed court costs;

15         (g)  In addition to any other penalty, every person
16  convicted of violating W.S. 31-5-301(b)(iii) by exceeding a
17  speed of eighty (80) miles per hour, or W.S.
18  31-5-301(b)(iv) by exceeding a speed of seventy (70)
19  seventy-five (75) miles per hour, or W.S. 31-5-301(c) by
20  exceeding the posted speed limit in a construction zone
21  established under W.S. 31-5-302 by six (6) miles per hour,
22  while operating a vehicle or combination of vehicles with a
23  gross vehicle weight or gross vehicle weight rating

 1  exceeding twenty-six thousand (26,000) pounds shall be
 2  fined one hundred dollars ($100.00).

 3 

 4         31-18-704.  Violation of speed limits; penalties.

 5 

 6  In addition to any other penalty, every person convicted of
 7  violating W.S. 31-5-301(b)(iii) by exceeding a speed of
 8  eighty (80) miles per hour, or W.S. 31-5-301(b)(iv) by
 9  exceeding a speed of seventy (70) seventy-five (75) miles
10  per hour, while operating a vehicle or combination of
11  vehicles with a gross vehicle weight or gross vehicle
12  weight rating exceeding twenty-six thousand (26,000) pounds 
13  shall be fined one hundred dollars ($100.00).

15         Section 2.  This act is effective July 1, 2001.
