Special event alcohol permit.

A BILL
for
1 AN ACT relating to
alcoholic beverages; expanding the
2 special
event liquor permit as specified; modifying permit
3
conditions and limitations accordingly; and providing for
4 an
effective date.

6 Be It Enacted by the Legislature of the State of Wyoming:
7
8 Section
1. W.S.
12-4-506(a), (b), (d)(iii), (vi)
9
through (viii) and (e) is amended to read:
10
11 12-4-506. Special event liquor
permits; authorized
12 for Wyoming Territorial Prison State Park and Historical
13 Site and Buffalo Bill Historical Center.
14
15 (a) Notwithstanding
any other provision of this title
16 and subject to subsection (d) of this
section, the

appropriate licensing authority may upon application, issue
2 a
special event liquor permit for the sale of alcoholic
3
liquor and malt beverages to the board of
directors of the 4
management group for the Wyoming territorial prison state 5
park and historical sas authorized by this section. ite
6 Restrictions
imposed under the retail liquor license
7 population
formula pursuant to W.S. 12-4-201 shall not
8 apply
to the a
special event liquor permit issued under
9 this
section. The special event liquor permit may be
issued
10 by the
appropriate licensing authority as follows:
11
12 (i) To the board of directors of the management
13 group
for the Wyoming Territorial Prison State Park and
14 Historical
Site;
15
16 (ii) To the board of directors of the Buffalo
17 Bill
Historical Center.

19 (b) The management group which is issued A special
20 event
liquor permit issued pursuant
to subsection (a) of
21 this section shall not sell authorize the
sale of alcoholic
22 liquor and malt beverages under the special event liquor 23
permit for
consumption off the premises owned or leased by
24 the management
group permittee.

2 (d) The local
licensing authority issuing the permit
3
shall by rule and regulation establish the following
4
conditions and limitations for the special event liquor
5
permit issued under this section which, to the extent
6 applicable,
are not less stringent than relevant
7
requirements and provisions of this title:
8
9 (iii) The
location of areas where alcoholic
10 liquor and malt beverages may be consumed on
the premises
11 owned or leased by the management group permittee;
12
13 (vi) With the
exception of the Horse Barn
14 Theatre located
within the Wyoming Territorial Prison State
15 Park and
Historical Site, alcoholic
liquor and malt
16 beverages
shall not be served as part of the Wyoming 17
territorial
prison state park and historical site's 18 permittee's
daily operations or venues;
19
20 (vii) Alcoholic liquor and malt beverages shall
21 only be served in conjunction with the Wyoming territorial 22
prison state
park and historical site's permittee's
catered
23 events or sponsored
special events;

1 (viii) If alcoholic liquor is and malt beverages
2 are being served for a
catered or sponsored special event
3 during
the permittee's normal operating hours, of the 4
Wyoming territorial prison state park and historical site, 5 the
site, area or property where the alcoholic liquor
is 6 and malt beverages are being served shall be
restricted
7 from
the general public and the perimeter of the event
8 secured
so that alcoholic liquor is and malt beverages
are
9 not
carried into other areas or properties of the park
10 permittee
where members of the general public who are not
11 participating in the catered or special
event are present;
12
13 (e) As used in paragraph (a)(i) of this section,
14 "management group" means the local
public or private
15 nonprofit entity serving as the single
management group of
16 the Wyoming Territorial
Prison State
Park and Historical
17 Site
pursuant to W.S. 36-8-1002(b)(i).

19 Section 2. This act is effective July 1, 2001.
