A BILL

 1  AN ACT relating to circuit court judgments; modifying
 2  procedures for filing a transcript of a circuit court
 3  judgment in district court; and providing for an effective
 4  date.

 5 

 6  Be It Enacted by the Legislature of the State of Wyoming:

 7 

 8         Section 1.  W.S. 5-9-138(b) is amended to read:

 9  

10         5-9-138.  Abstract of judgment; lien of judgment on
11  real estate; lien on real estate in another county.

13         (b)  The judgment creditor in any judgment rendered in
14  circuit court may file with the clerk of the district court
15  and record with the county clerk of the county in which the
16  judgment was rendered a transcript thereof, certifying

 1  therein the amount paid thereon, if any. The clerk of the
 2  district court shall enter the case on the execution
 3  docket, together with the amount of the judgment. and the
 4  time of recording the transcript with the county clerk. If
 5  within ten (10) days after the judgment was rendered, the
 6  judgment debtor pays the same or gives bond for stay of
 7  execution, the circuit judge shall immediately certify that
 8  fact to the clerk of the district court and the county
 9  clerk. The clerk of the district court shall enter a
10  memorandum thereof upon the execution docket. The cost of
11  the transcript, the filing, recording and the entry on the
12  docket shall be paid by the party who files and records the
13  transcript and may be taxed to the other party. The
14  judgment shall be a lien on the real estate of the judgment
15  debtor within the county from the day the transcript is
16  recorded with the county clerk. Execution may be issued on
17  the judgment at any time after filing the transcript with
18  the clerk of the district court as if the judgment had been
19  rendered in the district court.

21         Section 2.  This act is effective July 1, 2001.
